Does anyone know if I can claim back bank charges if I have an IVA?0

I am in an iva and claiming bank and credit card charges back. I have had some charges back already and have been paid directly off the debt i owe. I have a clause in my iva anway that says anything over £500 has to be paid into iva, anything less than £500 i can keep as its not cost effective for the ip to distrubute between the creditors. Halifax in particular said if the account is open (which in my case it is because of the debt i owe, even though i cant use the account anymore) has to be paid onto the account if your in credit with your account you could just draw the money out. Sadly i cant but im pleased its reduced some of my debts.:T This site is great! Thanks to Martin Lewis & everyone who participates and helps so many people! Without you all, where would we be ??:T

hi, this is on behalf of my sister, all help is gratefully received.
she has an IVA due to some previous debt problems. she has written the first letter to barclaycard to reclaim her bank charges, they have written back and said they have refunded the difference between the charges made and there new £12 charge rate. the difference was reapplied to her account.
Firstly this is the first time i have seen this, what should she do next? write back say this is unacceptable she wants the full amount owed and then wait for a further response?
Secondly can she request the refund is sent to her as a cheque or payed into another account as due to the account being tied up with her IVA she doesn't see any of the money and as such there isn't much point.

My dmp said you can reclaim bank charges, as you say it just lowers the debt you have with the bank. I am in the process of doing it now, £1700 charges with RBS and 2400 debt with them. will let you know how I get on.0

Hi all, I have debts of £11000 remaining with my payplan that’s been in place since june 2004.<O:p</O:p
In light of all the people reclaiming there bank charges I thought I d take the leap and claim back interest or late fees that were applied during the set up process of my payplan.<O:p</O:p
After calling payplan, and they said this was ok, I got a call back from them approx 10 mins later saying my creditors have a right to charge me, and that they would prefer me to run the payplan till the end, then claim back any interest or fees.<O:p</O:p
Problem is the payplan is not due to be complete till 2012, and the some of the amounts that payplan have on file fall short of the balances that my creditors have!<O:p</O:p
Can anyone advise me on what steps to take next?<O:p</O:p

Hi all im new to all this, but i was wanting to reclaim my bank charges but i am on a repayment plan. Its not an official plan, but one that was just agreed as i couldnt keep up with payments and then being charged on top - it got out of control! :mad: if i do reclaim they will close the account but i cant pay the debt off and would rather not go through the court etc. IS IT STILL WORTH TRYING??

My partner is on a plan agreed with Payplan. I went through his statements from RBS and he had over £3000 charges from them over 3 accounts. I used the templates from this site and we sent them off. I asked for interest too.
We quickly received the 3 letters saying they were looking into it (one for each account). Then about 6 weeks later (when i was just about the prepare the next set of letters) he received offers of all charges back (without the interest) as a gesture.
He accepted and they are paying the money directly into which ever account it was relating too.- ie an amount into each of the 3 accounts. They have still not mentioned closing the account. Although he doesnt get the cash it reduces his debt by over £3000 so I'm glad I made the effort. This site is great.

I sent my letter off to Barclays Bank to reclaim my charges and was offered £1360 which I accepted. I waited 6 weeks and eventually received a letter from Barclays saying that because I recently had an IVA set up they had sent the cheque to them!!!
Is there any way around this? The IVA was set up on 22nd March and I posted my first bank charge letter on 23rd March. I have tried to argue the point that it is a refund not a windfall but am not getting very far. Has anyone else found themselves in this situation? Does anyone know a way around this?

hi, ok we were talking about this great site out with friends the other day and i was telling everyone how to start claiming back their money from credit cards + loans... well the thing is that one of them sold her debts to payplan or whatever they do and she is unsure as to wether she can still claim her money back. she was told when she set her account up that if she came into any money that it would have to go towards her payplan account which is fine as if she gets anything back thats what she will do but is she allowed to go down this route??? i would hate to give her bad advice over this and get her into any more trouble money wise

Hi,
I have a friend who is registered with the CCCS and they pay all of her creditors on her behalf.
She has successfully applied for one bank account refund and has two others pending along with a credit card claim.
The bank claim was refunded to her account, therefore reducing the debt she has with them. It would be reasonable to assume that the other claims will be put directly in to the accounts concerned if they are still open.
There is no restriction on whether any person can put claims for charge refunds, whether they be with a debt collection agency, consumer service or not. It only has to be understood that any refunds made may well be returned directly to the account concerned, thereby reducing the burden I would say.
