I have a current account that is currentlyl "frozen" because I entered in to a debt management programme which was required after a costly divorce. One that resulted in me having full responsiibility for all the jointly accrued debt. This current account is in the overdraft which Iis why I have an agreed arrangement to pay.
Can I still go through the charge reclaim process? If I were to it would easily clear this specific debt?????

Hi,
yes you are still entitled to claim. Any monies reclaimed back will be offset against any outstanding debt. See the thread below which should be of some help to you 'claiming in a dmp/iva'

It depends on what your particular IVA company decides, please have a read of the previous posts and in particular the reply that Martin had from CCCS.0

Can I do it? It is overdrawn by about £1,600 I have changed banks as per CCCS advice as I needed help with debt and Barclays fell into that non-priority debt mark, so I do not actually bank with them anymore. Now I reckon Barclays owe us about £300-£400 in charges and we could do with that extra money what with a new baby coming. But when we win the charges back, how do we stop them from paying it towards the overdraft. we already have an arrangement through CCCS to pay so much each month?0

Someone will be able to answer officially Bluebell but it's my thinking that anything gained has to offset the debt....
It's not great but think of it as a way of reducing your debt... or maybe CCS will forego a months (2 months) payment in leiu of what they receive if you speak to them, so effectively you will still be better off cash-wise.I'm just a seething mass of contradictions....(it's part of my charm!)0 -
Any charges reclaimed against that Barclays account will go to offset the debt owed.
Speak to CCCS, but I'm afraid that there isn't a lot they will be able to do.
Be positive though, you will have paid-off roughly 15% of your debt to Barclays0 -
Does anyone know if I am able to relcaim my credit card and bank chargs even if I have an IVA?
It would be slightly cheeky I know as these account will eventivley been in the hands of my IP for my IVA, but IS it possbile?

Yes it is. Follow the process as usual and the refunds will be put first against any debts you have with them. This thread deals with the subject specifically and you can read of others experiences:
