The bank has a right to offset any money reclaimed against any money owed. It looks like your debt has reduced, be happy about it. In view of the OFT test case and claims being stayed I think the offer you got was really quite good - in fact that you got an offer at all was a result. I would investigate the account closure though, and the fact that you are asked to pay off the remainder in full even though you had come to an agreement before.Reclaimed thanks to this site:

please help new on here ,hav already posted thhis must be on some other bit sorry.I want to claim my charges from Halifax. from 1999-2005. after this date went into DMP. I rang Halifax today asked for list of charges and the answer was because I have changed my address I have to go into branch with I.D. etc change address, and then request list. any way my questions are:1. can I ask for these charges back as now I am in a DMP they still get money every month for my overdraft this DMP arrangement started 28/09/05.2. will they look at my claim because of test case?3. what does mcol mean?0

1. You can reclaim charges regardless of being in a DMP, but Halifax will only supply you with the statements of the last 6 years, and any money reclaimed will be offset against any money you still owe them.
2. They will tell you all claims are on hold for now, but it is advisable to get a claim in now to avoid getting your earlier charges time-barred.

thanks but they are still getting their bit every month they have agreed to thhe DMP. why should they take it and ofset. i am in this mess because of them! Are you sure they ofset it Has this happend to any one else.sorry to be a pain.0

am shortly going under a dmp with paypal to pay my debts of 25000 however i am also wanting to claim penalty charges of around 8000 back from all the various creditors. If i tried to claim these would i run the risk of the creditors pulling out of the dmp. Also would this be the same if i was in an IVA.PLEASE HELP0

I know the banks have asked for a stay there's a hold on claiming bank charges back, but I remember reading somewhere that if you're in financial difficultly that you can still claim.
I have £400 worth of overdraft fees with HSBC that I tried to claim back down the normal route, but when the OFT statemnt was annouced I recieved a letter to state they are waiting until the court case to see the outcome.
I have a DMP/IVA with them and several other compaines which I'm still paying. I am in full time employment but do not have any payments being made into this account as it was closed when I started my DMP. Would I be classed as in finacial difficulty?
If so is there a letter that I can use for this.

We're about to enter an IVA (creditors meeting scheduled), does this mean that we're too late to reclaim charges?
They wouldn't be enough to solve our problems, and I dont think that we'd be able to 'keep' the money but it might as well go into the fund we'll be building to repay our creditors since the charges have certainly contributed to our problems.0 -
Probably a silly question, but is it possible to claim bank charges while going thru an IVA?
Though saying that, its down to bank charges that my debt went out of controll :mad:0 -

One of the main reasons I have an IVA is because of bank charges - am I able to claim back my charges and would I have to disclose the amount won back to the IVA company ??0
