Claiming in a DMP/IVA (merged)

    Dear moneysavers, I am new to all this , having only recently popped my head out of the sand. I am toying with the idea of starting the claims process, but i fear it will be complicated.
    I am currently in an aggreement with Pplan (not iva) in the process of sorting out years of family mess. As such i have 2 current accounts (both now closed) Barclaays and Co-Op, which have a good many charges each. Also, a whole heap of cards with many a late payment charge. Have been with Pplan for 3 years now, and all creditors are happy getting their money. Firstly can any one help me by telling me can i claim.... and secondly does anyone forsee a negative impact in terms of companies getting the hump and demanding wads of cash. I fully intend to use any proceeds to further pay off debts, so in the long term its in their benefit . Any help greatly appreciated.:o

    MARBLES = £450 charges = £370 received (82%)
    I.F. = £494 charges = £494 received (100%)
    CAPITAL ONE = £981 charges = £1,489.03 (152%)
    BARCLAYCARD = £580 charges = £786.12 (136%)

    A+L = £722 charges (target = 147%)
    BARCLAYS = £1,405 charges (target = 128%)
    BARCLAYS = £175 charges (target = 140%)
    ABBEY = £3,220 charges (target = 148%)

    Thanks for that.... honest.. i'm not sat glued to my screen waiting for advice, well actually i am.... i think i'll start by contacting Pplan and getting a list of all accounts bank/ card/loans and see where it takes me. There are at least 15 different companies so thats why i am hesitant. At the moment everything is on an even keel. Just worried if i start to rock the boat they may all turn nasty.

    Any monies reclaimed are likely to go to the accounts that are in a debt situation, which will of course decrease your debt.

    Also be aware that any cards where the interest is frozen they may well stop this, have a read of previous posts in this thread.

    Edinburghlass..... thank you for the top advice, and for saving me hours trawling for the right threads. i promise i'll get better at this stuff. will post results on the appropriate thread .. if it happens !

    I have a dmp with the CCCS. I rang them to ask if it would be ok to claim charges from RBS. They were all for me trying. I am glad i did. The RBS have agreed to refund £2239.00. This will help to reduce the amount i owe them, which was my intention in the first place. I did'nt even have to go through the court process with them. What have you go to lose? This has given me the courage to carry on with claiming from others'.
  • im claiming nearly £900 in charges from my former bank,after sending in your template letter, i received a letter from my bank saying they needed a further 28 days too investigate my claim,on receiving this, i called the bank and was told that any money i did get back would be used to reduce the amount i owed them(£4000), i have a DMP with the CCCS and they pay my bank an amount each month to reduce my debt,can the bank do this or should i carry on trying to get my money back for me?

    If there is an outstanding debt with them, the bank or credit card company involved can and will offset any monies reclaimed against that debt.
    The acquisition of wealth is no longer the driving force in my life. :)

    My partner is on a DMP with Payplan and has tried to claim over £3000 back from RBS. He got letter 4 weeks ago saying they had received his claim and were looking into it. I just wondered how long you waited after that to get your offer - and was it for your full claim?
    Working hard to reduce debts and get better value for money :o
