Claiming in a DMP/IVA (merged)

  • I have had a Barclays account for circa 8 years and would like to take a look at reclaiming my charges.

    Trouble is I'm in debt to them through defaulting on barclayloans (now in the hands of their recovery unit) for circa £16K. I'm on a DMP with the CCCS.

    Can I still write and potentially request a reclaim? It would be great if I can put any payment from them towards my debts with them.

    Yes, you can still claim.

    If there is an outstanding debt with them and that debt is not covered by a separate contract, the bank or credit card company involved can and will offset any monies reclaimed against that debt.

    I believe that loans would probably be under a separate contract. Therefore, they should pay any monies into your normal account. However, if they do "try it on" and pay it into the loan account, they are just saving you the bother of transferring it! (Don't tell them that, though!)

    By the way, all due respect to you for your attitude towards putting your "winnings" towards your debt. I am afraid that I do have a low patience threshold when people moan that they cannot have a cheque to "blow" whilst leaving their debt the same!
    The acquisition of wealth is no longer the driving force in my life. :)

    ms newbie, i got the same letter as your husband. I must admit it took nearly 8 weeks to get an offer from them. Give them a ring on 0131 523 3245 they will let you know what stage they are with your claim. HOPE THIS HELPS, GOOD LUCK.

    I'm on a DMP with CCCs and have been paying into this since last October. When I defaulted on my personal loan (£5,000) the bank decided to add more than £2,500 in bank charges!! At the time I was so exhausted and didn't really pursue the matter. However, I'm now really angry and was wondering if I can do something about it?

    Yes you can claim these default charges back from the loan account, you can also claim from a closed account, good luck

  • Hi Have recently had an offer of bank charges back and that Natwest intend to pay it straight into my acocunt. However, my acocunt is closed and id being dealt with as part of an IVA. Not sure what to do? Any advice?
