Claiming in a DMP/IVA (merged)

    hiya

    to date I have been reclaiming unfair bank charges from two banks. First direct and Barclays. With first direct it came to £536 and i was offered back £455 which i accepted. With barclays it comes to £2940 inc interest. The problem i have it both accounts are closed and as im with the consumer credit counselling service the barclays one is part of my debt management plan. The first direct one refused to send me the money but have put it into the closed account towards clearing off my overdraft of £800..which is fine at end of day its less i have to pay them back. My barclays overdraft is only £605 which with the reclaimed bank charges leaves a difference of £2335 will they send this to me seperatly or put it into this barclays account even tho its 'closed'?? any advice wld be good:confused:

    its a subject access request,they have to give you all the information they hold on you or supply copy statements,they usually send statements,then you can work out how many charges you have had

    They will put it into the account and then the account will be closed and a cheque for the difference should be sent out. The term closed account where you are paying towards a debt means that it is closed for debits but open for credits.

    I'm in the same situation but i've been asking for a cheque which they have declined but i was told in the IVA it must be shared amongst all the creditors.
    So which one are we supposed to follow?

    Just to update Payplan has said it goes back to the original bank the charges came from and they have to send an update ot monies owed. Doesnt seem fair on the other creditors

    Hello everyone,

    I've been putting this off for weeks now, but I really have to try and reclaim charges.

    The problem is that I'm on a debt management Plan with the CCCS, and am worried if I try and reclaim charges from MBNA (late fees mostly) they will reinstate interest charges to my credit card, and cancel the DMP.

    The late fees are from about 3 or 4 years back, and since then I have been paying regular amounts promptly. The current balance is £1953.63

    Has anyone been in a similar situation, or any advice on whether it's okay to reclaim given my circumstances?

    Also, with bank accounts, can you reclaim failed standing order charges?

    They will, more than likely put any monies reclaimed towards the debt account but it shouldn't affect your DMP.

    Yes you can claim failed standing orders.

    I don't think you should worry to much - they shouldn't be able to withdraw the DMP from you while you keep up the payments :) as you are keeping to your side of the contract.

    I got £370 back off Marbles (HSBC) and I am on a similar scheme where I pay £14.57 a month (interest free ;)) for the rest of my life (well till 2013 but thats OK because the world is going to end in 2012 LOL).

    When you claim back your fees it is a totally separate issue and they can't really link the 2 issues. Don't be bullied into thinking they can and just threaten to call in the Financial Ombudsman (see link below).
