  • Hi,

Can anyone please answer this question?

I have recently commited to an IVA, which will hopefully enable me to get my finances back in order. My friends and family have been looking into reclaiming excesive bank charges and I wondered if I ws eligible. When the IVA was set in place, my bank account (Natwest) was automatically closed. Will this effect my rights to make a claim??

    I would appreciate any comments.

    Many Thanks

Yes you are eligible to reclaim the charges and the closure of the account does not affect this. Send off your Subject Access Request for your details enclosing the £10 fee if payable as usual and follow the process as usual.

You may find help and support in your situation in this thread which deals with claiming whilst under a DMP/IVA:

  • Help please..

Does anyone know if I am eligible to claim bank charges if I am currently under a Debt Management Programme. I banked with HSBC, had a loan, Credit Card and Overdrafts with them which must have cost me hundreds of pounds over the years. Over the past 2 years I have been making payments to them through a Debt Management Company. Would this go against me if I was to put in a claim.

    Many Thanks

As the above posts you can claim while in an IVA/DMP but it is likely any monies reclaimed will be put towards any debt or closed accounts but this will of course reduce the debt you owe.

Hi - I took LoydsTSB to court as they awed me £1400 in bank charges, there response was that the claim was embarrasing as I am on an IVA with a default to them of 2000.00. My IP had to be informed and I was advised that the IVA may collapse if I proceded with the claim. So I am pulling out at an expense of £120.00
