Hi!
I have set up a payment plan with the cccs! and during this time they encouraged me to go for my bank charges! Natwest owed my approx 900 quid which they offered approx 600. I accpeted and they paid it into the bank account and cleared the overdraft. I didnt matter to me that i was in a payment plan so everything is worth a go all they can do is say no and then u just keep fighting!!

Again I refer to this article. If anyone should decide what happens to the money you are reclaiming, it is the IP who controls your case0

My boyfriend has a credit card with capital one but is currently doing an IVA we 1st requested statements from the they arrived within 2weeks, then wesent the 1st letter request8ing the charges back and today he received a letter saying that they have refunded 120.00 back on to his account and he would see it on his next statement.
Can they do this??? plus we requested back 324.00 and all they refunded was 120.00 can we claim for the rest by saying that we will accept the part payment of 120.00 without prejudice and claim for the remaining 204.00. Also can we request that this money is sent to usin the form of a cheque????

You can ask for a cheque, but you'll find that most banks will repay any monies due into the account that is in debt.0

at this point the money would obviously be very handy as I'm absolutley brassic. But if it reduces my overdraft with them I would still be happy if the money went directly into this account.

I have 13 creditors and most of them have charged me excessive fees. Now most of the creditors have stopped charging interest (apart from Barclaycard and Morgan Stanley...no surprises there!). Is it worth 'rocking the boat' which might impact on my DMP or should I just go for it?
Any feedback would be gratefully received.

The prob i have is i haven't used the account since Aug'06, it's 2k overdrawn, i set up a new account elsewhere prior to this. My finances are dealt with by the CCCS & have been since Nov'06. Barclays want to repay the charges back to my account, do you think they would make payment elsewhere, forward a cheque, or secure themselves the cash back into the account.

They will pay the claim direct into the account you are claiming against (unless you can get them to agree not to but this is very unlikely). If this is less than the overdraft you'll not see any of the money unless you can get the CCCS to agree to release it, but there again they are more likely to say theclaim should pay off the overdraft first.
As a Barclays customer and with 2 claims against them at the moment, can I ask if this is there first offer to you and is it about 50% of what you've asked for? If it is then I'd say reject the offer!! They will make you another offer in 2 weeks, of you tell them you are going to take it to court! This is my 1st Barclays offer - i didn't want to push it too far as i was claiming interest as well. Do i just not reply to their letter? Have queired whether ay settlement be paid in chq tho.0 -
Hi there.
I have just started going down the road of reclaiming my bank charges from the Royal Bank of Scotland. I am currently starting a debt management plan with the CCCS. I owe RBS £2400 for an overdraft which is included in my dmp. I have just received the last 6 year's statements and having gone through I calculated that they owe me £1705 in bank charges. I don't know whether to just ask for all the money to be paid to me or whether I can offer to pay most of it towards the debt of £2400 and accept a smaller amount paid to me. Or do I have to pay all of it as I am currently under a dmp? I', new to all of this so can anyone help on this or offer some advice?0
