you can claim any unfair bank charges back no matter if you in a dmp, however when you win your claim you will need to tell you dmp supervisor as they will require some of the funds to go into you dmp0 -
just want to let some of you know that my dmp is being set up this month and yesterday RBofS offered me almost all of my bank charges back £1400, as they are in my dmp and i owe them £1600 they said they would pay it into my overdrawn account so i sent back the acceptance letter asking for a cheque instead as i will still owe them money and dont want to upset my dmp. The out come im hoping for is they will send a cheque which will go to cccs to reduce all my depts, will keep you informed of the outcome.0

I've just added up my bank charges from HSBC for the last 6 years - a huge £2096.50 (this would wipe out the o/d + leave some!!) my question is should I claim now or wait till my cccs dmp is set up as all my debt (including o/d which is included on the dmp) is with HSBC? Really appreciate any advice. Many thanks!I stopped smoking 25th June 2007STILL Never complacent but confidentMy debt is GOING DOWN!!!!0

just a p.s - am happy for any refund, should I be successful (??!), to be paid into the account and clear the o/d cause that will give me more money in the dmp to throw at the other debts. anyone out there able to advise. many thanks.I stopped smoking 25th June 2007STILL Never complacent but confidentMy debt is GOING DOWN!!!!0

I've gone ahead and claimed back charges from firstdirect and MBNA (who I owe money to) and as yet I've heard zilch from MBNA, and have sent back my claim letter to firstdirect, so I'll let you know how it goes. I'm not bothered who the money gets paid to, either myself or directly into the defaulted accounts, as it would end up in the same place eventually anyway lol0

could anyone tell me if u can still claim bank charges on a credit card account that was closed 3years ago. it had abalance of £4300 of which a good amount was charges. i paid a full/final payment of £2300 after it went to a dca
thanks0 -
You need to have a read of these previous posts regarding accounts with debt collection agencies.
If you are going to claim it would be 6 years back from now so that would mean 3 years of while your account was open.0 -

From what i understand from these boards you can claim off any account, open or closed. But the timeline is the only previous 6 years, so 3 years it was closed, so you would only be claiming on the last 3yrs of the account.
If im wrong im sure someone else will put ya straight, but thats how i see it0 -
And one more query that has me perplexed:
As I've just signed up to a debt management company who will be negotiating an informal plan with my hordes of creditors ... would it be deemed a waste of time for me to write to the credit card companies to claim on 6 years worth of unfair charges?
They're only now receiving word that I'm holding up the white flag financially (yet contradicting the situation by continuing to add those charges!)
I have no problem with them crediting my o/s balance with any offer they may make, but - as my debt management folk will ALREADY be negotiating with them to accept a final settlement BALANCE due to my abject surrender - would it or would it not be entirely smart for me to take them on via the opposing flank?
Thanks in advance for any comments that may spring up0 -
