  • This is a reply Martin had today from CCCS...

The following is the view of the top lot at the CCCS

"The answer is not very clear I'm afraid because there are too many variables.

Not all lenders freeze interest, so there may be no impact. For those that do, it may affect their decision whether to continue the freeze, particularly if they have had to fork out a lot in charge refunds.

I'm not aware that any have very specific policies regarding how they will treat DMP clients who request refunds. I'm certainly not aware of any clients who have suffered as a result of reclaiming their charges.

If a bank overdraft is comprised almost entirely of charges that were then refunded, that would essentially wipe one of the debts out altogether and remove it from the plan.We would expect the client to use the money towards clearance of the debts, unfortunately, as we are not actively involved in the process (i.e. we don't do it for them) we don't know to what extent they are successful and how much they get - we're reliant on their honesty!)"

Some of your questions may already have been answered in THIS THREAD.

Thanks Rex, but as you can see a few of us where asking the same question in that thread "will a claim have any effect on our DPM", but noone seemed to have an answer to that as yet, probably cos we were all waiting for some1 to answer before we went ahead and claimed lol, I got fed up of waiting and so far I can't see any problem with my DMP, but I've not got the cheque from the charges yet but I'll keep ppl informed of how it's going.

    Hi

I am also on a DMP with CCCS and know I have a LOT of charges from HSBC which could help towards some of the repayments. However, I am concerned as to whether this could affect their attitude towards my situation. I've been charged £25 this month for going over the overdraft (they wouldn't let me cance a SO for a HSBC loan).

Will be watching this thread and go and investigate the other as well.

  • hi there just want to update you on my claim, RBofS have told me that once your account has been closed (overdrawn or not) they would pay any claim by cheque or into another bank account that you request, im just starting my dmp with cccs so i will inform them when i receive it and they will take it off my total debt with all my creditors, minus £300 for carpet and beds for my boys room as we are moving from temp accomodation to council accomodation next week,(cccs said i could keep some as i am unable to get credit now)
  • First direct eventually replied to me, offering £700 of the £1026 I'm claiming, and say the money would be paid to my home address by cheque, so it won't go directly towards my debt with them (although it will be paid into my CCCS account)
  • Thats good news deavera, hope you get settled quickly into your new home.
  • Hey

After a lot of reading about this, I'm interested in claiming back the huge charges made to me over the past 5 years.

I'm currently in an agreement with PayPlan who are dealing with my debts (Pay them a fixed amount each month and they dish it out accordingly)

Seeing as my bank is one of the org's I owe money too, if I was to claim it back, would they then demand all money I recieve be put back into paying them off? Would payPlan have something to say? I'm a bit worried about calling PayPlan as they may demand me paying it all to them...

    Any help/Ideas? Please?!

Currently have a DMP with CCCS and my overdraft from old bank a/c is inclued in this. Can I still claim the charges from this bank??
  • just currently going thru a DMP with Abbey O/D, Loan and Husbands CC, but i know for a fact that we have been charged a few times at least £200 over 6 years, is it cheeky to ask them as that will get paid off our overdraft if we do?
