  • Doh, TSB not Natwest! In that case what they'll probably do is use the fees recovered to partially pay the balances. They might at that point default them and hand them over to a DCA, it's hard to tell. Hopefully someone more knowledeable will be along soon :D

  • ok thanks, not sure what to do as they have been quite good and dont want to be hasseled by a Debt Collection Company, its not going to be enough back to pay for what i owe, think i would get about a thousand back and owe about 6000 on a loan and 3300 on cards, have to have a think.
  • mine is just being sent to a dca but that is because they are not happy with the £1 a month offer from the CAB . if they tak eme to court apparently the judge would agree with £1 a month as i am on benefits .

    i want them to pay it off my existing debt so i can get it paid off asap

    I wonder if anyone can give me some advise, my bf had run up lots of debts, over 30,000. I have got him all sorted and he has been paying a DMP with cccs for nearly a year at 400 a month. Was thinking about trying to claim back his bank charges as would be loads. Going to read up on everything on forum as know differences because we are in Scotland. Question I have is how does this work on DMP, obviously his accounts are no longer used and he has a basic account elsewhere. I presume that if he was successful that companies would take monies of his debt to reduce it. Would they just do this and would I need to contact CCCS to let them know this has happended. Sorry for long winded post, it's just don't want to do anything that would muck up his DMP as obviously we want to get this cleared.

  • I wouldn't recommend estimating charges as if this comes to court you need to provide lists of your charges as your defence.

  • I am currently subject of a debt management program with the CCCS and it's their opinion that claiming back charges while on this is well worth considering.

    Any retaliatery acions by the credit company would in their view be wrong.

    This is on behalf of my partner, who is is a large amount of debt (50,000 to be precise).

    A lot of this was accrued through Lloyds banks very high charges, which caused a snowball effect each month, causing him to take loans to try to clear it. On advice of Payplan (who he has a repayment plan with) he is now with a different bank, and i believe Lloyds defaulted against him.

    Can he claim charges even tho he is on a repayment plan, and has left the bank?

    Also can he claim charges against credit cards? This would mainly be Egg.

    As an example, IN JUST ONE DAY Lloyds charged him £115 in charges. How much less debt would he have been in if these sort of charges had not been applied i wonder?
  • Have a read of these previous posts as I think the problem arises as to who the money would go to if successful with a claim.
