One of the accounts in question is in my sole name, the other jointly held with my husband. Am I able to take action on my own? And do I just pay one fee for both accounts or do I have to do it as two separate actions?
And most importantly, how much is it going to cost me?!

I started the claim procedure against my bank (Barclays) several months ago. I got as far as writing the second letter (I have had no responce at all from them) then I moved house & broke my computer with all my records on! The next stage would be to start MoneyClaim procedings. I have now managed to retrieve my records from the broken computer. Sould I start the whole process again as there has been such a long gap (waaay longer than the 14 days I gave them in the second letter!) or just continue from where I left off?0

Hi,
My name is June and I have just joined in the hope that someone will be able to help me with Barclaycard.
I wrote to them claiming back my overpaid charges and interest in August and have recently had a letter back from them offering me 200 pounds, being the difference between the 25 pound fines they had been imposing on me and the recommended 12 pounds. Now the reason they were imposing the fines was because they said I was missing payments, I wasn't, I was just paying what I could, part of the reason for not being able to pay the full amount was what they were putting on top, it was just a vicious circle.
So I need to get back to them to say I want the interest as well, but am not very sure how to word it.

If you've already informed the bank that you would start court proceedings if they wouldn't settle, then just go ahead now and issue a court claim. It's obvious from the no reply to you that they wont pay out without you taking it to the next step.How many surrealists does it take to change a lightbulb?

This is a choice for you now depending how far you are prepared to go. £12 was the MAXIMUM that the OFT considered a fair charge. You could still choose to press them for the whole amount, and if they refuse. Take them to court for the whole amount (plus interest). As part of your case, you would have to have to ask them to disclose the exact amount it cost the CC company each time you incurred a charge. Chances are that this was nowhere near £12 in each instance. Under the Unfair Contract Terms in Consumer Contracts Regulations 1999, the Unfair Terms Act 1977 and common law, the banks are only allowed to charge you what it cost them each time time you went overdrawn. Any more than this could be considered a penalty charge (a fine). This is the unlawful part. You could take a gamble that if you ask for this information to be disclosed to the court, they will not in any way want to disclose it (and settle out of court so they don't have to). I've just drafted my letters to HSBC.
I'm only claiming £430 from them.
I am scared that they might close my mortgage account with them. Does anyone know if:
a) it is likely
b) it is legal?
On a second point, I had lots of trouble with my cheque accounts in the past, these were with co-op and halifax.
I don't have the account details anymore. Do you know how I can get hold of this information. I'd love to get the money back that they claimed from me!

Hi folks
I have searched for an answer to my question in the forums but can't find my specific issue - sorry though if it is out there somewhere!
Basically, I am interested in reclaiming charges from my current accounts and some credit cards. In all cases bar one, however, I am in an interest free repayment arrangement via the CCCS (Consumer Credit Counselling Service). I feel that in a couple of cases, charges would amount to a large proportion of the debt still owed and so reimbursement of these would considerably reduce my overall debt. I don't want to start the process, however, and find that any claim adversely impacts on the arrangements I have in place currently - eg would the banks concerned then be justified in taking me off the repayment plans and insist on charging interest again?
I have worked hard to get to a point where my debt is managed and as you can imagine I am reluctant to jeopardise this arrangement if possible - even if the overall debts were reduced by the reclaimed charge amount, I would still need an interest free repayment arrangement ... it would just mean I might be debt free before 2012!!
