Hi.....hope Edinburgh lass is still on line..........sorry to be a pest, but just double checking, ....when I work out my bank charges and intrerest for each one, thats it isnt it...........thats the total you claim for , or do I deduct an amount which I feel is a fair charge ????? TOTALLY lost due to the fact I had an email from a freind (( both doing the same, with same bank )) but his total for his charges was EXTREMELY high.......it seemed that he worked out his charges plus interest for both of his accounts which came to quite a high amount for eg: lets say £16,000 but then he said that he should be claiming £25, ooo in total..............ANY HELP PLLLLLLLLEASE........... have I done this all wrong ???????????

    You called :)

Ignore your friend and concentrate on getting your own claim right! Yes you input each charge into the Interest Calculator with the date as a charge taken in 2001 will incur more interest than a charge taken in 2006. Don't take off any amount, its not up to you to consider what is a fair charge, let the courts decide that one!

if you have been charged interest on these bank charges can you ask for the interest to be refunded as you would not have been charged interest if they hadn't of put the charges on ????????
    can you do that?????

Provided you can prove that the interest is due solely to bank charges you can claim back that interest, please read the Reclaim Help Thread which is linked in my signature.

    Hi

Has anyone had any dealings with G E Money Consumer Lending - which was orignally known as First National Consumer Finance when I took out my loan - I have sent the first letter giving them 14 days to reply - they replied saying that the fees were in the terms etc - so I then sent of LBA giving them another 7 days to which they have replied again saying that all fees applied within terms - therefore they are unable to reverse any fees to my account.

What should I do about this - has anyone else claimed from them or do different rules apply to loan accounts?

Twinkly or Edinburghlass - I'm sure one of you could answer my question above - you both seem to know your stuff ;) Thanks

As i had no reply from the halifax to my first two letters sent to them i have today paid £120.00 to start court proceedings. After reading other threads it seems that the Halifax have usually paid out before it gets to the court stage. Wondered if there was any one else who has had to take the halifax to court and what happened?? Thanks

You'll find a link to the thread for Halifax in the Reclaim Help Thread which is linked in my signature.
  • I have a joint account with my husband and we have used the first template to notify the bank of our intention to claim back bank charges from them.
We then sent a letter with a cheque included for £10.00 asking for bank statements from the last 6 years ( I have only the last 2 years).
Within 10 days we recieved a letter from the bank offering us £1400 and no liability. The letter stated that we would have to accept this ammount within 8 weeks or they would close the matter.
My query is how long should i wait for my statements to arrive and should we accept what is being offered without seeing our statements?
We are quite prepared to go the whole hog with this and have opened a dialogue with the financial ombundsmen - but i feel i could do with a little moral support.

    Thanks for help.
I havent recieved a Notice of Issue Letter yet from the court.
    What is it?

its a letter from the court confirming that your claim has been filed with the court.
Mine had a Response pack letter attached that had been filled in by the Banks sols.

My bank (Barclays) has decided to defend my claim in court. Has this happened to anyone else. Do they actually mean to defend or will they decide to make me an offer without actually going to court, because as I understand it they won't disclose how much it actually costs them to send out automated letters, or how much it costs them to reject direct debits, standing orders, and unauthorised overdrafts.
Has anyone gone to court yet, or have the banks not turned up after they said they would defend the claim in court.
    Any help much appreciated.

My HSBC bank is defending as well. Just sit tight.
