First Direct (HSBC) have acknowledged my MCOL claim against them today too. Will have to see whether they decide to be obstinate and actually threaten to go to court.

Does anyone know how long I have to wait after a claim has been acknowledged before I can ask for judgement (assuming they take no further action) ?
    Reclaims in progress:

    Smile: Claimed £3124 Paid: £3124

First Direct: Claimed £8178 Paid: Court date 14th Aug

    MBNA CC: Awaiting statements

I have a joint account with my husband and we have used the first template to notify the bank of our intention to claim back bank charges from them.
We then sent a letter with a cheque included for £10.00 asking for bank statements from the last 6 years ( I have only the last 2 years).
Within 10 days we recieved a letter from the bank offering us £1400 and no liability. The letter stated that we would have to accept this ammount within 8 weeks or they would close the matter.
My query is how long should i wait for my statements to arrive and should we accept what is being offered without seeing our statements?
We are quite prepared to go the whole hog with this and have opened a dialogue with the financial ombundsmen - but i feel i could do with a little moral support.

This reads to me like you are using letters from different sources in your claim. If you are going to claim the "MSE way", read Martin's article and follow the step by step guide. If you have gone with claiming through the FO you need to let them do their job.
  • I was wondering if any one can help, last month I reclaimed my bank charges from Barclays with little problems. I have recently sent a letter to Lloyds along with list of charges, it totaled about £850.

I have just recieved a reply in it it states "The Office Of Fair Trading has published new guidelines on crdeit card default charges. We're still talking it through with them, but the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situations.'

So basically they are not gonna pay!!! The thing I dont understand is that the times I got charged were when I went over my overdraft, I didnt ask for permission prior to going over!!!

Can anyone shed any light on this???

    Thanks Nicky

reading through the threads this is one of there fob off tactics...i hope ...they usually take it to the bitter end but dont pull out..!.they have just acknowledged my claim so they now have a further 14 days ....but i won the Halifax after 2 standard letters and paid full amount 3250.00 so how can 1 bank agree with the customer and another not ??? we shall see
