  • can anyone help me here,i`ve started claiming my charges back through robertson holbrook,but as yet have`nt heard anything back,sent forms away to them on 23rd feb....,can anyone confirm that this company is legit..and won`t do a runner...lol

    My experience with ABBEY is not good. They are quite a scheming lot and will drag things out on purpose to wear you down.

    My claim was this:

    I had bank statements anyway
    Claimed 280
    Reply back very standard not personal saying the needed 4 weeks
    After 3 weeks another standard saying needed another 4 weeks
    (any wonder they score so low in customer service surveys!!!!)
    I shirtly replied, this is a stalling tactic demanding money.
    A response in a similar tone 3 days later saying they had investigated fully (even though they said they needed andother 4 weeks - I smell a rat and a few porkies!!) and would not refund anything.
    As I have a large overdraft with them and have heard they can be agressive and close accounts, I have not pursued it.

    The onlt course of action with ABBEY is to be tough with them, they don't care about you and will do anything to put you off. Good luck

    You can reply stating they have failed in their obligations under the Data Protection Act in requiring in excess of 40 days to provide the information. The reality is they are probably snowed under but this is not your responsibility, it is theirs. You can complain to the Information Commissioner about the breach. It may give them a push.

    If you requested the details as a Subject Access request under the Data Protection Act then they have failed in their obligation to provide the information in the statutory 40 days. You can complain to the Information Commissioner and advise the bank you are doing so, it may give them a push.

    Do not under any circumstances go to court on an estimated amount. you are required at court to provide proof of all charges and dates. It is incredibly frustrating I know but all you can do is wait for the remainder of the statements. You will get your money back eventually, try to bear that in mind and good luck :)

    Abbey appear to be the hardest bank to tackle on reading the posts. Have you any info on any successes as I have trawled through at leat 30 pages on the succes thread but didn't see any for Abbey. Is this an omen for us with claims against them?
  • I have put in a claim to nationwide, but my question is, because i am already over my overdraft limit, they are still adding charges to my account, can i still reclaim these charges, even tho my claim started before these further charges where added, in the last 2 months and including this coming April's charges they have added nearly £300 in charges to my account, all because they added £80 in charges to my account in january which took me over my overdraft limit, which then esculated from there, as i am only on benefits, i cancelled all further DD that i thought where in use and had my benefits paid into another account (post office card account), but as further cheques which were already sent had to go out and one direct debit that i overlooked that would go out in March, they have now added another £160 of charges for april, all for going over my overdraft by £20 in december.

    So the question, as i'm now moving on to the court stage, is can i reclaim March's charges which weren't on my intial claim and will i be able to put something on my claim about further charges in april and subsequently may if it takes that long for court proceedings?

    Hiya yes I agree Abbey do seem difficult to deal with and my analysis of them in the success thread shows the following:

    I have noted 18 cases of which:

    5 settled in full before any court action neccessary

    11 settled in full plus costs and interest after claim filed at court

    2 claimants went to the Financial Ombudsman and the banks paid in full for one and more than the amount claimed for the other but no reason for this is given in the post as to why it was more than the amount claimed

    Hope that helps :)

    You can add charges right up to the minute of filing a court claim and they will all be reflected in the particulars of claim for the banks information at that point. I would do this on receipt of the most recent monthly statement even if it means waiting a few weeks to do so. The burden is on you to prove the charges and have evidence so personally I would add on any pending charges as you will have proof of those even before application on the monthly statement.

    With regard to any incurred or pending whilst the court case progresses. Whilst you cannot add to these to the claim in progress you do have room to negotiate all the charges right up to the date of settlement and acceptance. You can state that any settlement offered must include those charges also before you will accept. They may not agree to this but it is worth a try. Dont sign anything to say that you will not claim in future. If they will not refund the latest charges you can counter that you will just go ahead and reclaim them anyway, surely they will see the ridiculousness of it ? Lets hope so.
