    I followed Martins templates to reclaim bank charges. Filed my calims on line - !st for about 2.5k the 2nd is for about 3.5k. They have acknoledged my claim:mad: . I was hoping they wouldn't and I could have got judgement by default. I an now really cacking it as I am more that likley going to end up in court!:confused:

    Is there anybody else out there who files against HSBC and got this far into the court process and still got their charges back?:confused:

    See the stats I posted above. They may acknowledge the claim but not file a defence. This has the effect of just delaying things and can be intimidating but hold your nerve. :)

    I am going through the same, i haven'tr got as far as a court summons yet though. HSBC offered me 1300, but they owe me over 2000, so i'm taking it to court.

  • Its good to hear that there are other people out there in the same situation! My husband thinks I am mad and I am going to loose everything!

    I am thinking positive and wont be taking him with me and the kids for our summer break (depending if we get money back)!!:j

    I sent in my 1st letter before xmas, and they had the cheeky to stop all my direct debits and they are still charging me. Now i dont have my wages payed into there as they are trying to take all my money.

    So i'm definately taking them to court

    Hi!
    I'm claiming my bank charges on line and the bank has untill today to launch a defence. If by tomorrow they haven't done this then i win be default. They have not acknowledged my claim online at all even though I said this is what I was gonna do. Should it go ok and I win by default tomorrow, how long would it be before i get my money?

    Hi there, this is my first post. I sent the first letter to the data protection department of halifax 42 working days ago. I got a letter about 2 weeks ago saying that they were dealing with my request and have had nothing since. I notice you say that they returned your cheque, however when i checked my recent statements I noticed that they cashed my cheque 1 week after I sent my letter off (so 35 days ago!!!) however I still have no statements. When I ring Halifax on their general number they say that they can't help me and I need to speak to their data protection team, however when i ring them there is an answer machine, I have left a message but no-one has got back to me. :mad: !!!

    To top it all off I told my friend about this website and she sent a letter to halifax asking for her statements and she received them within 2 weeks even though she send her letter off at least a week later than me! It sounds to me that the department in Halifax that is dealing with this has no idea what it is doing!

    I am not sure what to do as i am reluctant to just sit and wait for Halifax to get my statements to me, however I am not sure what else I can do. Do you think it is worth sending another copy of my letter to Halifax or should I send them another letter pointing out that they are in breach of the data protection act!

    Sorry about the long post but Halifax have really got my back up!
    I am grateful for any info !!!

    Yes, this might have the effect of giving them a push. You cannot do this until the 40 days are up though. As they cashed your cheque 35 days ago you have this date as proof they received the letter on this day at least and can irrefutably count 40 days from then. Leave it 5 days then send your letter. Good luck :)

    The 28th day for a Defence was up today, checked MCOL and they have
    defended, exactly the same as Barclays Bank did a few weeks ago to me.
    I know someone on here mentioned - enjoy the defence blurb of the claim - which I did, absolute joke.
    After that Whistleblower programme last week I would have thought that Barclays would have been more sensible. Wishful thinking obviously.
