I'd be hugely grateful if one of the wonderful moneysavers on here could help me out with a quick question.
I've worked out what I'm owed and wish to write to the bank requesting my money back. My question is, what evidence of the charges do I need to include - sholud I attach the original statements they sent me, reproductions or is it ok to have a list of charges with date and interest added to the letter? The bank in question is Lloyds TSB in case that's a factor.

Hi jobytc I personally included a list with my letter writing down charges as notified the date and the amount of each charge then totalled them at the end The bank have acknowledged this ok, make sure you keep a copy for yourself, I also stapled my charges to my template letter, which gave them no excuse to say they had been misplaced, also use recorded delivery so you have proof they received it:)BORN TO RIDE - FORCED TO DRIVE

Hi, I am in a similar situation at the moment, I have signed my acceptence letter from DG Solicitors and sent it back to them over a week ago, despite continual phone calls to both HSBC and DG I have heard nothing since, I finally got through to DG today (after getting a different number online), who said they only deal with settlements once a week (Friday) and that they would inform HSBC of my acceptence this Friday, and that I should then get the money in a week to ten days, the only problem is that I have had an allocation questionaire from the court, which needs to be back to them by 3rd April with another 100.00, I do not think that I will have the money by then so:
1) Do I continue with my court case, bearing in mind that I will need to send off more money, I have signed the letter of acceptance and agreed an amount, so I could not add to this to my claim.
2) Is the offer letter from the solicitors legally binding ? So no further action through the courts (on my behalf) be neccessary?
3) If letter is not legally binding, is there any way to put off sending back allocation questionaire for a while untill funds clear?

From the tone of your post I think you want a way out of the court process ?
If not - I would write to the solicitors advising you withdraw your acceptance of settlement on the grounds of unreasonable delays in processing correspondence and non-payment of settlement to date. You can then continue to court for the full amount & interest & costs. This would be my choice personally. You cannot delay payment of the AQ fee though.
If so - ring the court and inform them you have settled with the bank and they will advise you what to do with regard to stopping proceedings. It is then up to you how long you are prepared to wait for payment.
You could write advising the bank that settlement is accepted and in the hands of their solicitors should they wish to check and that you require the monies paid into the account immediately upon their confirmation. Do this in writing recorded delivery. Also get in writing from the solicitors the date they expect to or have informed the bank of your acceptance.
Advise the bank that ,from information given by the solicitors over the telephone, that you expect settlement to be paid no later than friday. You have waited long enough already in my opinion. You owe them no favours, start insisting0 -
Further to my last post 22/3 - I have gone online to reclaim my charges, even though I'm in the Isle of Man, as long as I had an address in England for where the papers would be served, I could claim. I will let you know if I am successful, let's hope so!!!0

Called Alliance and Leicester today, spoke to an advisor to ask if they had received my 2nd letter as I'd not heard anything.
She told me that they has sent out a 2nd letter on the 15th March basically saying that the bank is not going to pay and she would send a copy.
So I will now have to start legal proceedings.
Can't believe so many people have got their charges back that I know, but I'm having to take them to court for mine. Has anyone else been dealing with Alliance and Leicester and had the same outcome?

I have started a claim again HSBC Bank Plc with moneyclaim online, issuedto HSBC 26/03/07, they wrote to me on the 20/03/07 which I received on the 27/03/07 offering me £2030 out of the £2514 that I have claimed, I have writen to they accepting their offer, they claim they will pay the money within 7 working days of receipt of my letter.
But im now a little concerned as as I have started my claim after the wrote to me but before I received their offer that they may withdraw the offer when the claim is recieved
Hopefully they won't0 -

Some stats gathered from the success thread which may help with claimants against HSBC.
7 were settled for more than the claimed amount, no mention of court in these cases and I assume interest was given before court.
32 cases were settled in full without the need for court and some after the first letter only.
72 cases settled for less than the amount claimed but for not much less than claimed, presumably without interest.
Of 4 court cases noted:
2 were settled in full by, the bank did not defend and default judgement was awarded after 14 days.
1 settled in full after court claim filed.
1 settled for less after court claim filed and it was accepted by the claimant.0
