I am also claiming charges back for my other half. One account he had years and years ago got passed to a DCA. I have now found out their name and address from the bank so I presume I just send exactly the same letter templates?0

to claim all of the default charges which are rightfully due back to me.
I know its a damn nuisance but County Court action is the only way forward.0 -
Hiya
I opened a joint account for a previous boyfriend 4 years ago as he couldn't get a bank account. He then got an overdraft of £750.00 and spent the lot. Obviously I didn't have a clue about all this until cheques were bouncing and the rent wasn't getting paid. I threw him out and took the bank on and explained situation. I had to end up paying half of the money that was left in the overdraft £375.00 and then i closed it.
I have today sent the first letter to them asking for the statements.
If they give back all the charges will the ex get any of the money back to him or as i have made the recovery steps will I receive all the charges back?
Just need to know as I won't pursue if the ex will benefit from it!!

Lloyds TSB have replied to my initial letter seeking copies of statements/charges just before the 40 day deadline, stating they need further time (possibly another 40 days!!). Do I reply seeking an immediate response or go straight to Information Commisioner. Has anyone actually complained under Data Protection legislation? Thanks0 -

Put post on last night but it was taken off, i think possibly because i mentioned a persons name at customer service at Lloyds.
any way i.ve had the patronising reply from Lloyds and have now sent letter threatening court action in 7 days total £1007.

Hi there,
I wonder if anybody can help. I've only got my last two years bank statements from Abbey and have now written to them 4 times and authorised them to take £10 from my account to cover the cost of sending me the other charges. This has taken 9 weeks so far and I only have standard responses telling me they will reply in another 4 weeks. Can I take them to court with an estimated amount?

HSBC closed my daughter's bank accounts today, without warning. they retained her card as she tried to use atm. when she went in to bank, they refused to give card back, admitted it was because she was reclaiming charges. She had to do a sit in at the bank, until a manager came to see her, and eventually gave her some withdrawal slips! They did say after some argument that they would transfer mortgage payment if she went to the bank with details tomorrow. All accounts closed, even savings, and all direct debits cancelled. I think this behaviour is also illegal.0

Yes same templates but send the letters to the bank not the DCA. it is the bank who supply the details under the Subject Access Request under the Data Protection Act not the DCA and to them you must direct the claim for refund of unlawful bank charges. I would include in the SAR letter that you want full details of all costs incurred and paid by him as a result of the matter being passed to the DCA.

Technically he is entitled to half of the charges. Pretty much in the same way as you were entitled to half of the overdraft facility that he totally spent. Reclaim the charges and draw your own conclusions as to my advice on whether he should get half of the refund.0 -
