    Just to add, it's the same as here and on lots of threads recently, search this forum for 'Newlyn' as a keyword and you will find several like this:

    The Newlyn computer has obviously just issued a batch of 'scraping barrel' follow up threatograms which no doubt makes some victims worry and pay up. You are not a victim and on MSE even a small claim is rare and defendable with a high win rate for our posters. I think VCS just lost one last week didn't they, others might recall it, 3 tickets being chased and the defendant was up for the fight! Apart from that I can't recall one before that except Ibbotson which they also lost (shown as a link in the NEWBIES thread, post #6 small claims cases won, well worth reading!).

  • The OP again! Today I have received another letter from Newlyn titled - "DO NOT IGNORE THIS LETTER - COURT ACTION PENDING"

    It starts with "We are instructed to recover the above sum, arising from a PCN issued by our clients Vehicle Control Services Ltd.

    You are formally advised that unless the payment is received within 14 days, proceedings will be initiated in the County Court where a judgment may be obtained. The CCJ may then be enforced by a court appointed bailiff which will incur substantial costs." etc. etc.

    I am hoping that the vague "may" in "a judgment may be obtained" means it is just more !!!!!!!! but what do you experts think? Is this an official 'Letter Before Claim' or should I continue to ignore?

    sounds like another toothless DC letter

    only VCS or the landowner can raise an LBC or court papers , and newlyn are neither
  • I've had the same letter today for my pcn from Robin Hood airport in June 2012. Is the advice to continue to ignore this latest letter? I have ignored all letters since this began as was the standing advice at the time.

    already covered in the previous rteplies (including mine) and also in the NEWBIES sticky thread too , especially yours which is pre POFA 2012 so they can only chase the driver, not the RK , never mind the fact its not POFA compliant as its not relevant land either

    Thanks Redx. I have read all this in detail but wanted to make sure I was doing the right thing. I have decided on the FOAD letter route and will post separately shortly as I am just getting annoyed with it all now and the ignoring it is not helping me. I would appreciate yours and others feedback before sending.

    To whom it may concern,

    Further to receipt of your letter today I am writing to confirm that I have no intention of paying you or your client any amount of money and any court proceedings will be vigorously defended.

    As the date of the alleged offence was pre POFA, I am under no obligation to divulge the name of the driver on that day so it would not be in your interest to threaten to pay for a Norwich Pharmacal Order. Due to the fact that nearly two years have passed, I am unable to remember who was driving my car on this occasion.

    I have copied this letter directly to Vehicle Control Services Ltd, therefore I would suggest that you also return your file to them. I am confirming that this charge is disputed on the basis that I am unable to identify the driver of the vehicle and I will no longer deal with anyone other than your client or the land owner. Should you continue to contact me then this will result in a complaint to the Credit Services Association.

    The original charge is not a genuine pre-estimate of the loss incurred for the alleged offence. The alleged offence caused no issues on the road in question and the vehicle was only stopped for a brief period as it was blocked in by your clients van and a car parked in front of it as shown in the photos on the original Vehicle Control Services Ltd letter and therefore the loss can be calculated at £0.00.

    Also as stated in my original letter to your client which was written following legal advice no contract was entered into by the driver at any point.

    Should it be your client's intention to start court proceedings, they must provide a Letter Before Claim which complies with the requirements of Annex A Para 2 of the Practice Direction on Pre-action Conduct which I'm sure your client will have a copy of. If not it can be found at this link

    Please also note that a failure and/or refusal to comply with the Practice Direction will result in a complaint being made to the court and an application for a stay of the action and costs pursuant to the provisions of paragraph 4 of the Practice Direction on non-compliance and sanctions.

    I have taken further legal advice in this matter and unless you and Vehicle Control Services Ltd desist with this spurious claim I will have no choice other than to take action against you and your client for harassment.

    Hi, some of this seems to have gone off the original post.

    We would be very interested to hear what happens your side with this. We will let you all know what response we get.

    This is quite interesting because it seems these latest letters have been sent out to people who either ignored or refused to pay up nearly two years ago. It must be a computer generated thing because I would guess if you haven't paid before now you certainly don't intend to do so now.

    We also have been told that the parking companies sell off these "debts" to the debt agencies so the that's why this happens so long after the event. Is that a possibility?
  • Hi I have just received a parking notice for £60 if paid in 14 days for breaching terms and conditions of use of the privately operated acces roads at Liverpool airport. It was very late at night and we drove in to pick up family and parked on a layby on the roundabout for about 60 seconds. That was on Saturday night and I received a fine today Friday. Is this legal and do I have to pay it. It is in my name but I wasn't driving it was my husband I was a passenger. They have sent the charge notice and it has photos on of the car? I would appreciate any help with this thanks.
