    You need to wait for a letter through the post regarding this.

  • I recently received a parking charge from parking eye for overstaying when parking to shop. I have been given many forms of advice from just pay it to ignore the letters! I knew I wouldn't feel happy ignoring the letters with the risk of this going on for months-I didn't want the worry hanging over my head. I decided to use MSE advice and appeal. I used the guide on this website and went straight to the militant approach! I provided receipts to show I was shopping in the store and although ovr the alloted time, I was shopping throughout the time. I stated that I reject the charge and that I refuse to pay. I made reference to the charge levied being disproportionate. I also added the unfair contract argument. I ended the appeal stating I would not be discussing this any further. I was most surprised when I received a reply stating the charge had been cancelled! Most impressed and I wanted to share this to highlight a carefully worded letter following MSE advice can be a success!

    Good result. From time to time PE do actually cancel charges when receipts are produced.

    Whilst most of us regulars agree that the production of receipts is a 'secret' element of any supposed 'contract' the motorist enters into and want the opportunity to present itself where this is challenged legally, for the average PE 'victim', anything that can get the monkey off the back asap is clearly worth pursuing with receipts to PE.

  • Hey, just wanted to share some news regarding parking charges.

    A few weeks ago I was sent a "fine" from a company; although the document showed images of my vehicle entering the (TESCO) car park, and leaving the car park and stated that I owed £70, there was no indication WHATSOEVER of what I had actually done to incur this fine. I phoned the company to ask what the charge was for; the lady could not disclose that information on the telephone, I would have write for a detailed report. I phoned TESCO and was told they don't deal with the charges; they have a company that regulates the car park. I physically got in my car and drove to the TESCO to see if I could get to the bottom of the issue. It took me 10 minutes of driving around the car park before I realised the issue. Stapled way above my eye level, on the street light on the other side of the lot, was a sign saying "2 hour limit". Now tell me, how is a driver supposed to see a sign 8 foot up when we're focusing on navigating the parking area and other vehicles??!!

    I spent the better part of an afternoon doing research online and made use of the Template I found on the MSE site to argue. I started out stating that I would NOT be paying the fine for several reasons; I was shopping in TESCO and could produce a bank statement to show this, the signage was inadequate, the fine was disproportionate to over staying 6 minutes and ended saying I would not enter into correspondence with them regarding the matter, and again stating that I would not pay the fine.

    I received a second notice the following week saying that as I had not paid within the time frame my fine was increasing to £100. I ignored it! The following week (3) I received a letter stating that my correspondence had been received and as it was my first offence they would waiver the fine as " a gesture of good will"!!!!

    So, thank you to Martin and the MSE site for your good advice! I'm not saying every one has a case, just that if you think you meet even 2 of the criteria that Martin lists, it's worth a try!!

    @klikyd - well done on getting the charge killed, even more so doing this on your own by reading the wealth of information on the hundreds of recent threads on how to do this and taking the necessary action with the PPC.

    Kudos well deserved. Newbies - take note of what is feasible on a DIY basis.

    Well done on beating Highview...but you missed a trick by not simply strolling in when you went back to check the signs. The Store Manager can cancel these scam tickets on the spot. Also missed a trick by listening to the fob-off reply from Tesco on the phone that it was nowt to do with them (it was everything to do with Tesco because Highview are their agents!).

    And just so newbies know, Martin's criteria is restrictive & a bit out of date; the forum threads are newer of course, look here newbies if you never actually discovered the forum!:

    No POPLA decisions have been published and it is not clear whether they will be. I have now been told that because of confidentiality no decisions will be published. In my view, if they are not this will give a tremendous advantage to the parking companies and be very disadvantageous to motorists. The reason is very simple parking companies individually will see all their own decisions whereas the motorist will only receive his or her own. If the parking companies exchange details of their individual cases with other parking companie the advantages to these companies increases and the disadvantage to the motorist increases.

  • I appreciate you're a newbie but some of your stuff is crap and you should really read more of the stuff on here before saying anything more.
  • If the parking companies exchange details of their individual cases with other parking companie the advantages to these companies increases and the disadvantage to the motorist increases.

    There's a thread on here and another on pepipoo listing a large number of appeals [mostly successful].....so whilst would be nice if popla published it's not really necessary.

    As long as the motorists claims 'invalid pre-estimate of losses' they will win.

    Job done..

    Of course, one could make an FOI request to popla wrt reasons for upholding appeals
