He'll have to pay it theres no way I can afford to, My attitude is going to be one of its his fine, so its his problem. One of the reasons I'm so fed up at the moment is that the entire family seem to just see me as a cash machine and I'm actually broke, I just can't afford to keep subsidising everything and everyone all the time, by the time I've paid for bills and food etc theres nothing left.loobylou2.Proud to be dealing with my debts and aiming to sort out the mess in 2013!!!!:eek:0

Telephone the court and ask if you must fill it in and what the implications are if you do not, it has not been sent to you after all which it should be if it was manadatory. It may be that without your details he automatically gets the maximum fine which is tough. AFAIK you are not liable for his fine under any circumstances, it is seeing if he can afford to pay based on what is coming into and going out of the household.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0

Personally I think I'd seriously consider filling it in with

Thanks for the replies everyone. In the boxes where it was asking for outgoings for bills etc I just wrote " Paid by partner" and in the more information box just put that although we live together we don't have joint accounts and that I wasn't prepared to take responsibility for the fine. Honestly, I love the man but he drives me crazy at times and just hasn't got a clue about how much things cost apart from things relating to his car. He may end up having to sell it in order to pay the fine tbh but that might not in itself be such a bad thing anyway as he could have paid the fine anyway with what he's had to spend on repairs for it recently and the thing still keeps breaking down!!!! Have made it clear to him though that I am far from happy particularly because he didn't tell me about it in the first instance when we could have sorted it out much more easily and cheaply!!!! Am not pleased!!!!!loobylou2.Proud to be dealing with my debts and aiming to sort out the mess in 2013!!!!:eek:0

Here is the PDF of form MC100
If your OH's pension is his own, he doesn't contribute to the household and you pay all the bills, why not use the other information box to state this and leave out the details? After all, they are trying to punish him, not the whole family.
From the sound of the state of your marriage, if I were in your shoes I'd be very reluctant to let him have my financial information just because he waves a form at you. That form is down loadable, as is the CAB one.
Take care.0 -

Ahh! We cross posted. Good move.0 -
I've been given a form from the court asking for financial details prior to even being liable for a fine.
I think they sometimes send it out so they can assess what is an affordable amount for you to pay in regards to a fine.
I don't see the problem in putting your details down as then it is clear how little income is left to pay the fine and your payments will be lower.
I know you say you are not willing to pay HIS fine but as you seem to be supporting him then in essence you are paying it just not directly.0 -

If you don't fill in the form then they will assue that he is able to afford the full fine - he won't get any means-tested discount.
The same would be true if he was applying for means-tested benefits, etc.
I don't believe this would link your finances in terms of credit reports, etc. I don't think it would make you liable for the fine.
Whether you make yourself liable for the fine - by paying it or by paying for something else that he can't pay for because he's paid this fine - is up to you.
Whether you want to help reduce his fine by supplying your income details is again, I would have thought, up to you.0 -
Yes, you do have to do this.
It's an offence not to complete the form with the 'means' information and that offence in itself can result in a fine of up to £500.
Don't mess about writing in 'partner pays' instead of the correct figures, unless you want him to get fined for this additional offence as well.
It's not something that's optional, fines are set according to the household income/expenditure. Having separate bank accounts etc is irrelevant. I don't know if you could get in trouble for non-cooperation, as well as him, but why risk it. Seriously, don't mess about with legally required court forms.
Also, just so you know, providing false information is also an offence with a fine of up to £2500.

Wow, what's going on? £700?? 36mph in a 30 zone should be a standard fixed penalty fine of about £60 plus three points on your licence. For this sum to have swelled to £700 he's really neglected things. That's your real problem.
In terms of whether you need to provide these details, others have already confirmed that the courts are entitled to know the income of the household, and that includes you. You're not liable for his debt though."Growth for growth's sake is the ideology of the cancer cell" - Edward Abbey.0
