Think that's going to be the biggest problem kim, that you didn't tell them he was there even as a lodger. His lodger money should have been there to pay your rent instead of hb paying it if you see where I'm coming from.

But then you say he is hardly there - so can't really be helping? You need to get your story straight - at the very least you can expect an overpayment because you have failed to declare he is living there. You may also receive an administrative penalty for this, but that will be at their discretion.0 -

no as they dont class mental health that they cant see as a problem.

now i am confused. what would he do if you had not needed support and asked him to move in. he would have had to pay rent for his own flat so why is he not paying any towards yours????0 -
I would imagine they would want all the housing benefit paid back from when he moved in, in January. So if I was you I would make him pay it back from his savings for you. His wages should have been taken into account since January for calculating your benefits.0

His income will be a factor I would imagine, even if he is just a lodger. And he is living off the state even if he does pay tax hon, he's living rent free when he shouldn't be. Even as a lodger he's got to be listed as living there. And should be contributing to rent. The DWP will be able to give you figures as to what he should be paying.
