Ofcom’s response to what they consider our first Freedom Of Information request.
“Firstly, by way of background, I can confirm that we have been actively engaging with Orange on this issue to fully understand its position.”
Followed by a lot of spurious blurb about getting sympathetic treatment from Orange if we ring yet another number;
“Secondly, returning to your request for information, I am writing to let you know that the information you have requested is not held by Ofcom, that is, transcripts of meeting(s) held with Orange, as we have not met with them to discuss this issue.”
Great to see we’re being looked after by the regulatory body set up to oversee “sharp practice” as they say on their website.
Anyone who want the PDF of the letter please contact me.
Makes for great reading and creates such a feeling of warmth and security.
Hi Nick ( or should I say Perry ! )
I know you picked up on it but this is why I said to include email & telephone conversations in the FOI request.
It does not suprise me that Ofcom have not even met with Orange - based on the type of email responses that we have had from Ofcom ( not to mention the time it takes for them to respond ) it is clear to me that they are far from keen to do their job.
I was under the impression prior to this whole fiasco that regulatory bodies like Ofcom and other quango esque bodies like CISAS were there to help `Joe Public` when situations like ours occured. In reality though it seems it is more about taking a quick buck, business lunches & no doubt fat salaries and alike.
Unfortunately the average person in the street will most likely never have to deal with them and thus nothing gets done about it !
Keep on fighting the good fight and have another glass of that home brew.

But no doubt I will be lambasted by the part time Perry Masons on here who think they can single handedly bring a multi-billion pound company and its corporate lawyers to its knees with their home brew legal genius.

The above meeting took place 21st September 2012 (and posted on that date) - how then is this statement correct?

What a joke!
Think I need a glass of home brew followed by a lie down to take these incessant lies on board :beer:0 -

It may be even more to it... I would not be surprised if some time later we find out that the big bosses of Ofcom were on the take from Orange... This is why EE "won" to roll out 4G first and this is why Ofcom turning a blind eye to what appears to be criminal offences (mis-selling) by Orange.0 -
Would it be possible/helpful to send a copy of the petition to Parliament with, probably, some explanatory notes plus the reply from Ofcom sent to NickBirkin regarding FOI? This is to show that Ofcom IS NOT DOING what it is supposed to do!0

Trading Standards are the body to investigate and instigate criminal charges - and why it needs to be consistently reported via CAB as we the public - do not have direct access to them.

Hi Eva,
I think it was most likely phone calls - no more than that.
Ofcom putting their foot down with a firm hand !
Like being savaged by a dead sheep.

We should get the response to
"all and any CORRESPONDENCE with Orange in respect of this subject, as there may well be emails etc that have relevance on this issue."
on 20th November and having re-read Ofcom's emails I suppose I might have to put one in asking for copies of their "discussions" and "engagements" with Orange, just in case they seek even more wriggle room.
They know exactly what it is we want, and the I.C.O are being kept in the loop, as they are keen to see if Ofcom is being deliberately obtuse on the matter.0
