    I've had enough with no replies to my letters to my Bank, so I'm starting to proceed with Court Action 'Online' as so many have done so.

    But I'm going to do it by the Small Claims court, as read its free to use as long as the amount of Claim is under £5k and the Interest can be added to this up to the day I start the proceedings and when and if I win. Yet I see from the online court charges for a £5k claim, they show a charge of £120.

    Is my reading of all these various links wrong or what.

    Can someone in very simple english tell me, what is correct regarding fee's and the max. amount of claim in a small claims court before interest is added can be made.

    yes. it does cost up to £120. u may be able to get exemption in some circumstances. have a look at this thread (help thread) and scroll down to edinburghlass's post on the costs of court action. Good luck.

    How did you get the impression that filing a court claim is free? It is only free if you are on certain benefits. Using the Financial Ombudsman is free though. Oh and the value of a claim is determined by claim amount AND interest, so if the interest takes you over £5,000, you will have to pay £250.     I'm not sure where you read its free to use as it tells you in Martin's article that there are initial fees of £30 to £120

    Sorry if the heading seems emotive or arrogant but having learned the hard way myself, I want to help other MSE people avoid making the initial mistakes I made when going via Moneyclaim / County Court.

    It's true that it can be daunting and confusing, but it is most definitely essential to make the time to have a good plough through all the help and threads on this site and also the Consumer Action Group to ensure that u are absolutely 100% clear on what u are doing, work out the costs involved and what - as in my case - to do if your bank really digs it's heels in. If they do 'defend' you will have to be able to prepare a 'Court Bundle' and be ready to actually attend and take them on. Although this senario is unlikely, you have to mentally prepare yourself this way.

    It's hard work, but if you're claiming back a grand or three , the hourly rate works out quite nicely. And, it's also a very empowering and educational process to put oneself through.

    As Beate said, the poster may have got mixed up with the Ombudsman.

    Yes. I made a mistake / omission on my Moneyclaim form on-line. It was my fault and down to lack of proper prep and concentration. This is defo a potenial pitfall with Moneyclaim as there is very limited space to enter the particulars of claim. It cost me another £35 to put this right. I found the Helpline at HMCS to be very helpful.

    I am claiming £2176.00 + 213.50 ( interest) + £120.00 (court fees)

    I received a letter from the court informing me that a defence has been filed. They enclosed a questionnaire that I have to fill in and send back before the 16th of July 2007 together with £100.00.

    Now my question is: why do I have to pay a further £100.00? Is this the procedure? If so, will I be getting this money back if I win the case?

    Any advise from you guys will be highly appreciated.

    Have a read of the Reclaim Help Thread where you'll find a link regarding further court costs and yes you will get this back. You'll also find the guide to filing in the Allocation Questionnaire in there.
  • I am in the process of filling out my Allocation Questionaire. The final section asks for a fee but I thought that I had already paid this when I went through moneyclaim online.

    This has confused me somewhat.

    Any help will be massively appreciated as the deadline for me to get my form in is looming.
