The bank has put in a defence, so my claim has now been transferred to my local county court.

I rang MCOL this morning, and they told me that the Allocation questionnaires have been scrapped, as the banks are wasting the courts time :D

My claim is over £1500, so I paid MCOL the £120 court fee, when I filed online. They have told me that I have to pay an additional fee to my local county court, before the hearing.

I called the local county court, and they said the judge decides what the fee will be, but it is usually £275!!!!!!!!

Can anyone confirm that this is the case?

Why is there an additional cost, at the county court?

I am overdrawn at the moment, and HSBC continue to add charges to my account.

    Thanks

I havent heard of this but if the court have advised you of it then I would take a wild guess and say that yes, its true. I'd also ring the court back and ask them to explain a lot further. I'd be interested to see what they say if you would be so kind as to post their full explanation. With the advent of scrapping the AQ's, which has been reported a few times this week now on the threads, all information is gratefully received :)

I contacted my local county court today to ask them about the fees for the allocation questionnaire and they have told me that if your claim is under £1500 then you dont have to pay for the AQ fee.

at the moment im on benefits and dont have to pay the court fees or for the AQ fee luckily. hope this helps a few ppl though
  • Hi just filled in that form ! what a headache!!!

Anyway, im claiming nearly 6 k with interest, but I didnt realise that the court costs are £250!!!!

Is this right, this seems steep, I thought it was £125?

  • I'm in the process of awaiting a response to my LBA. Can anyone please advise what fees can be included if using MCOL in my claim total? I'm assuming that the fee I pay to register will be added on top. My claim is for over £1500 so I have read something about an AQ (allocation questionaire) and a cost involved with this. Is it possible to also add this cost to the claim?

    Thanks

If you win, any court fees can be added to the claim.

The claiment has to pay the court, so when you win the defendant will have to repay the claiment. It should be added to your charges once you process the MCOL.

Q My daughter thinks that you have to pay a further £100 when you submit the Allocation Questionnaire but she is unsure if this is just re businesses and not individuals
Has anyone gone this far and been charged? It is hard to keep paying up when you are broke and overdrawn
