Hi I think you are only exempt for court fess if you receive the diability element in working tax credits. To file at your local court you need to take a claim form, the schedule of charges sheet, and a sheet calculating any interest owed. You need 3 copies of each of these, 1 for the bank, 1 for the court and 1 for yourself. I filed my claims yesterday at my local court. They are very helpful, hth,

Sorry for the typos I meant regarding tax credits you are only exempt if you receive the disability element in working tax credits.

Hi Just read one of the success stories and in one it stated that their bank put up a defence and they had to pay a further £100 for court allocation??
Is this right?
I submitted my moneyclaim papers last week and they were issued on monday (14th) to LLoyds TSB.
Just waiting now but hope I don't have to pay out any more, already had to borrow £120 to put through small claims.
All advice welcome

If you have to fill in an Allocation Questionnaire, I gather you have to pay an additional £100 when you submit it. However, Northampton seem to have "dispensed" with the AQ, although advise it may still be required by your local court.
I've just had proceedings transferred to my local court, stating that the AQ may be dispensed with, BUT I rang the court and still have to pay an extra £100 as my claim is over £1,500. I presume this is standard.

can anyone out there please advise why I have been asked to pay an extra £100 to the Court as well as complete a Allocation Questionnaire. I have already paid £120 and just do not have the other £100. What will happen if I dont send the fee with the form?0

These are trial fees, if you don't pay it then presumably it won't go any further. Have a look at the links in the Reclaim Help Thread which is linked in my signature, where you'll find links for any exemptions.0

I decided to send the form and copy bank statements and a letter saying I could not afford the £100 but asked . I could apply for the fee exemption or remission. I also put my telephone numbers and asked them to call me before the case is dismissed. I just dont get it, we are totally skint and the bank are still sending threatening letter due to the fact my account is now overdrawn. I am also on antidepresents as I am so stressed about this.0

Im going to start to reclaim my charges from Lloyds. The £65 charge they slapped on me 2 days ago has topped it off.
all im worried about is it seems lloyds like getting to the court stage which im not scared of but if it gets that far, will i have to pay to take them too court and how much?0 -
