  • can some 1 tell me how much it costs to go thru the small claims court ? iam at that stage now after having no response from my three letters to the bank (natwest) iam claiming £2650 inclusive of interest and is it a troublesome process ? tnx

    I'm in the process of reclaiming bank charges of £1600 plus interest - so around £1850 - on behalf of my son. He's been offered £600 but has decided to try and go for more. I wrote to HSBC about 3 weeks ago declining the offer but saying that if they increased it to £1200 we would settle (with hindsight was this a bad idea?) but have heard nothing - so this morning started to fill in the Court forms online. However, instead of the £30 fee I thought we'd have to pay, it was calculated at £120 - presumably this is right? In light of everything that's been going on recently at Hull court, I'm now wondering whether it's worth proceeding - £30 is not too much to lose, but £120 is!

    Also, I noticed on one of the threads that someone's case was referred to Hull from Northampton - which is where we live - is this standard and going to happen to us? I'd appreciate some advice.... thanks!

    The court fees are based on the amount claimed, and £120 is correct. When you "win", you get this back.

    All claims start out at Northampton, because this is where MCOL are based. If defended, they are transferred to the claimant's local court.

    The situation in Hull only involves one judge, who - quite understandably - is trying to find a way of stopping his court being swamped with bank and credit charge claims. Unfortunately, he seems to think the claimants are an easier target than the defendants. Wrong!

    my court fees were also £120 and are calculated on the amount you are claiming. The £30 you thought is for claims a lot less than yours. The £120 should have been added to the full claim on your mcol form and therefore should you win - my understanding is that you will be paid court costs with your claim - although my claim is with Nationwide and obviously I don't know who definately pays out on court costs and who doesn't - hope this helps but i'm no expert !!!

    The defendant can ask for a change of venue to a location more suitable for him.
