Divorce (through mediation) what can I expect to retain

  • As your youngest child is 8, and your wife has just given up her job to claim benefits, she will have to claim JSA and will be expected to take steps to seek work. She may also be required to attend work programmes. You shouldn't be giving her any money, apart from child support (20% of your net pay - make sure you pay by bank transfer and label the transaction as 'Child Support for child X and child Y', to protect yourself and provide proof that you have paid this).

The OP is paying the mortgage and AFAIK all the bills, he doesn't have to pay child support as well does he?

  • He is only obliged to pay for half the mortgage (unless it is solely in his name), and is not obliged to pay the bills. This is assuming that his wife is still in the marital home (it is unclear whether she and the children are still there, because he says she has declined to stay there, but has not moved into affordable - social? - housing yet).

Any bills that are run up after the separation are her bills, and she should pay for them from any benefits that she receives. In addition to JSA, she will also get CTC, CB, and council tax benefit. Her children will be entitled to free school meals, and depending on the area, possibly a uniform grant and free school bus pass.

The OP should be paying child support plus his share of the mortgage. Obviously this could mean that the mortgage could go into arrears, and he may prefer to pay the full amount, but if both parties are on the mortgage, they have equal responsibility.

We are not yet separated,we are still under the same roof.
My debt payment has now gone from £240 a month to £420 plus I have to attend mediation sessions at £240 a pop.

I am going to stop her pocket money,I was doing this to try and keep things amicable, but she has gone beyond that.

She needs petrol money to run our son to school, but that can now come out of Child benefit.

I pay all the mortgage and all the bills the house is solely in my name,I offered her the option of staying in the house.but she refused

You need to have a notice of disassociation applied to your credit files so that any further credit that she may take out isn't associated to you. You can't do anything about existing debt though.

Thanks who do I contact to apply for this

I have been told she is entitled to 70% of the house (assets)Which would leave me unable to afford property Nearby to where the children will be,therefore making it costly to have the kids regular and run them to school when I am off work

Just wondering who told you this.

Your solicitor or 'a bloke down the pub'?

I'm really struggling what to do with my debts,I currently running up a credit card just with things like household shopping, petrol.
If I apply for financial Disassociation does this only apply to future debts,as I want the household debt to be cleared by both of us after mediation

Disassociation will only apply to any lending in the future.
