    Only update so far other than the judge saying I should try mediation is that I have a date for this - 1 week today, half 10 on the 6th of December.

    I am keeping an open mind in the hope that when I explain to them that they have no right at all to keep my money they will just pay up. As I have detailed to them before the only reasonable outcome is to refund ALL my money, and I am sticking to this.

    Anyone who is still following this and more in the know than me... what parts of the distance selling regs can I quote directly? I will be having this thread up when I am on the phone.

    So if anyone happens to be on here at half past 10 on the 6th I will be giving a kind of live feed of events... a first for MSE perhaps?

    At half past 10 this morning mediation will be starting to try and resolve this. I will be posting updates during if I can, or straight after.

    Anyone have any ammo suggestions I can quote to them?

    Just tell the mediator what you want and by when and your position is non-negotiable. Leave the ball in their court.
    If they agree a resolution during mediation, is the decision legally binding?
    Is it an hour slot?

    Post up a summary afterwards. Good luck and hope you get what you want.
  • It is an hour slot. I think I am just going to tell them I aren't going to shift and if they don't agree to giving all my money back it will cost them more by having to drive to hull to attend court and perhaps point out that they have not complied with distance selling regs. The mediation part will be me offering them one more chance to save themselves the expense of going to court and losing.

    Good luck - be firm but polite, explain things clearly, and when they come up with something irrelevant don't be afraid to tell than that 'the law states'...
  • Thanks guys! I will be polite and explain everything as I see it. I won't be giving them anything though because there is no reason why I should!
  • Currently offering me £76.43 refund! I have refused and said I will take £121.00. I will forget the court fees and just give them one last chance to refund what I am owed. Lets see what they say now...
  • Come back saying best they will do is £100. Again refused this. Explained that it is more than fair for me to only take £121. This will save them the £25 fee I have already paid, along with the next £25 hearing fee and the expenses of a trip to hull. If I don't hear back in 10 mins they have refused my offer and looks like I will be seeing them in court.

    Make sure you get settlement in full before dropping the case, they sound like a totally shady bunch. Why give them any discount at all after they've strung you along so long? Personally, I'd insist on the full amount, even if it meant the court hearing. Whilst they're at court they're not taking money from more unsuspecting customers.
