I am on the phone to Orange and BT right now to get all records should I need them...
Once the courts get all the documents I am sending them then I think any judge will see they are just trying to rip me off and it wont go further and a judgement will be made without me going anywhere... or do I need to go to court now it has gone this far?0 -
Consider issuing a Notice to Admit Facts in respect of the factual points which are in dispute. This may help in respect of any costs which you incur as a result of proving facts.0

Bod... Just realised I havent replied about the restocking fee... They havent made any mention to that at all. Just claim the £121.43 is the cost of return. Not sure where they got that number from. Anyway, I have sent my papers off so just wait and see again.
Now I have to think of ways I can make sure others arent stung by these. Local press. Going to contact all the suppliers they list (probably wont do anything) and also going to see if they are part of any kind of association who I can inform too.0 -

I was thinking to myself earlier that I have spent an awful lot of time and effort concentrating on this issue with the paper work and back and forward with letters and emails etc.
Now... I dont believe in compo (unless it is genuinely warrented... loss of earnings etc) but could I make QS pay for my time?
Would I be able to do anything about it now that I have already made my case and the courts have it? If I can, how can I do it?
If there is nothing I can do then I'm not really that bothered. Ultimately I just want MY money back, nothing more nothing less, but they have wasted lots of my time.0 -

As well as getting your money back and the personal satisfaction of defeating them, I think this is a good learning experience in case you need to do something like this again and/or need to help family and friends.

Thanks very much for that message. It made my day. I'm not doing anything exceptional, just want what is mine back. It isn't lots of money, but it is my money which I worked hard for.
There is lots of satisfaction to be had doing this. Hopefully I win the case to make it worthwhile. I will gladly help anyone who needs it now I have a small insight as to how the system works.
Got to say though, none of this would have been possible without the fantastic help of everyone on this forum! Said it before but now the end is in sight, a sincere thanks to you all. Even if I don't win I have learnt a lot!0 -

No. It is Small Claims track so no costs unless the District Judge decided to make an award (which is extremely doubtful).0 -
Hello all,
Just heard from the courts and the letter says the judge feels this case is suitable for mediation. I don't believe this will work as I have tried reasoning with them as have trading standards.
Any idea what I should do next? I am contacting mediation to arrange all I need to through them.
Can anyone see any reason why 1) I should accept any less than I paid, and 2) any reason they can legally keep any of my money?

I suspect (though have no real basis for this) the SCC case load may be high so they are trying to limit what goes before a judge. Stand your ground is my opinion.0
