I will do that then, just add £5.90. I cant imagine the courts would want the receipt for that would they?
They probably did see me coming... I had just landed at Blackpool airport after 2 weeks at sea and was knackered, just asked for it to be posted as quickly as possible and to be signed for.
It is a small price to pay to get my money back I suppose.0 -

Based on your correspondence with them, it's probable that your claim to sending them a LBA special delivery to be true. This will be what a court is looking for.

I will file if I dont get a reply tomorrow. I would have done it a while back but decided it best to let TS do their bit first. The forms are all filled in and saved on moneyclaim, just need to click send.
I am taking solace in that for sure! That and how I have slated them on every review site I can find and directed all attention to here to see what they are like... with any luck my advice to others has cost them lots more than they have tried to steal from me.
One thing I have been thinking about it what would happen if I filed, and in the time between it going to court and when I file, they pay me my money back? The way they are going about business I doubt that would happen, but you never know.0 -

Assuming the deadline you gave them had passed, personally i'd treat it as part payment towards the total debt inc court fee. Then seek to have the judge award the remaining unpaid £25.0 -
Update again...
I have been talking to trading standards and we have not been able to come to a solution. They still want to keep some of my money to cover the money they spent on transport... which as anyone who has read this will know is a load of rubbish. So the court papers were submitted this morning to claim all my money back.
Lets wait and see what they say now.
As a side note, what happens to them when they lose this case? I will get my money, but how will it effect them as a company? Will it be damaging to them? I mean in respect to both trading standards being informed and the courts.

If you win, they have 30 days (or 28 days, can't remember which) to pay, after this the CCJ is made public and could affect their ability to borrow in the future (in the same way it would affect an individual).
Although you are supposed to pay 'forthwith' ie straight away. But it's always good to engage them in dialogue if they haven't paid after a few days. IE 'please make payment as instructed to by the courts to my bank account xxx. If this has not been sorted by [date] I will instruct court appointed bailiffs to visit your property at your expense.'
Enforcing a CCJ is payment isn't forthcoming can be a challenge in itself as many companies simply block access by bailiffs, some will Phoenix and the debt disappear with the company, etc etc.
But now the claim has been filed better cross that bridge if it comes to that. You may well find they do the sensible thing and pay before it gets to the hearing0 -
I hope they do the sensible thing and pay up ASAP. On the other hand, I would quite like to see them try to justify to someone at a court just how they believe they are in the right.
Finally the end may be in sight! I am trying to think of all the ways I can do stop others using this outfit. Hopefully this thread will help, and all the other reviews I have done.
I am trying to get others to write to watchdog too, that would be interesting to see.0 -

UPDATE -
They have received the court papers and aren't making it easy. They have now put in a defence. I really aren't sure what it could be as I haven't got the papers yet but I imagine it is going to be quite odd.
I will update again once I see what they have said. Going to submit all my emails to the courts in response to their defence. I can't possibly imagine any courts believing they are in the right.
