Hope this is in the right section

Hi

5 years ago I had account with Lloyds Tsb, I was fed up of their charges and joined another bank, I left the account with 3p in it and left and never thought about it again

A year later I get a letter saying I owe them £750 ?? I asked why and a few weeks after leaving the account with 3p in a charge of £35 came out, that was then charged the next month £70 and so on untill it reached £750 !! So I never had a penny, just unlawful charges in my view

This was 4 years ago, about a year and half ago I received letters from some company chasing payment, I ignored this because it wasn't my problem i hadn't left the account overdrawn i didn't have a overdraft etc and didn't spend a penny . They soon stopped

Now this month Im having letters sent to my parents house (where i was living at the time) from ZINC saying they are chasing the payment for lloyds for £750

Of course they won't get a penny as the last company found out as it was 5 years ago, I haven't touched a penny of it and they are unlawful charges

can anyone help with any advice Am i right in my stance?

any help or advice would be great

why did you leave the account open with 3p; no doubt they would have already sent you a letter advising of the charge that was pending. The assumption being that you knew of the charges that were pending.

Why didnt you choose to remedy this after the 1st year? should have entered discussion then when they may allowed some form of settlement. Looks like youve still got a couple of years before it becomes statute barred..

12 months on Im sure you will just get the same advice..

Why didnt you discuss the charges with Llyods when you first got notified of them. They must have applied them for a reason? If you had address it with them then, I'm pretty confident they would have cleared them if it was their error. But instead you left it and now you have a debt recovery company chasing you they arent the bank so wont care how the debt appeared they will just chase you for it.

Talk to the bank about it and get it sorted out rather than sticking your head in the sand an ignoring it.

Well i just left the bank, so changed all the direct debits and wages to another company as i was fed up with lloyds, and when i took the money out etc i left 3p (better than anything minus I suppose) and walked away

I Haven't had a penny of that money so why should I pay it back? That's the way im looking at it to be honest, I thought bank charges back then were unlawful

Yes what you should have done is closed the account, why leave 3p in it ?

You were given advice last year yet you chose to ignore it, why ?

It is 6 years before it becomes enforceable, not five!

That said, you have not explained what the £35 charge was - a DD or late cheque presentation? If so, the charge will be valid, and your responsibility would be to have formally closed the account. By not doing so, your responsibility for the account continues and it would be very to argue otherwise, especially if you only lef 35p in it, then did nothing to fund it thereafter.

Have you checked your credit file? Did they default you?
