Interview Under Caution for Undeclared Capital.

If you are in receipt of IS this should be a joint investigation with the DWP/JCP FIS as you should be on a passported benefit so unless they decide to cancel periods of your IS your council tax will not be affected.
Looking at the thread and what the OP has stated I would say it is probably to do with the bank loan and has come about as part of a data match.
If you took the loan out and used the money to purchase a car as stated, then take in your finance agreement and invoice for the car and all should go ok as this will prove your version of events.
But like I say as council tax is passported based on your IS so I would be surprised if the DWP were not going to be in attendance.
Although IS and ESA in payment together as separate claims is a little odd as either one of you should claim for the other on a joint claim, but I could be wrong!
They have told me that only the housing staff will be in on the interview....2 of them. There will be no attendance by DWP. The woman did tell me that much.
My husband claimed incapacity and dla first and then I gave up work and received IS and carers allowance. I believe it went in as a joint claim but with me having the IS element as they refer to my husbands benefits on my IS confirmations that come through the door stating what's deducted from my IS due to his benefits etc. Carers allowance is paid weekly and seperate from my IS money. My husbands incapacity was changed to ESA and is pd fortnightly as is my IS money. Both my husband and sons DLA is paid seperately and every 4 weeks0 -
better than Corrie this :rotfl:
dieing to know that they think they have on you as you seem to be up on all the details, think they will be wearing egg on their faces0 -
I hope so.0

I really hope someone hasn't "dobbed you in for having a new car" - they should do more homework before something like this.
let us know how you get on. one final thought - Are you on your mothers home as a named owner etc?0 -

No. Definitely not.The only name on my mums house is hers. If she goes into care then they'll force the sale to pay for her care which is very much just around the corner.
The car was a year old when I bought it and is now 4 years old so surely they'd have done something when I first bought it 3 years ago. I agree they should do more homework as this has caused me no end of worry.0 -
Unfortunately they will not disclose any case information prior to interview or prior to (unlikely) appearance at court.
They will ask a series of questions and record the answers.
That could be the last you hear other than a letter to say the investigation is closed.
The "big file" is part of the psychology, often it is just general claim notes with a single sheet which could be a transcript of a call from an informant, the big file gives the impression they know everything, it's usually the same file, a old ring binder that looks big.
So don't go in expecting them to put the cards on the table, they don't.
If it's just spite, they will ask the questions they require information from, make the decision and inform you.
If they pull up something in questions you feel needs more thought, stand up, suspend the interview and make an offer to reconvene at a later date.
Remember at all times, this is for them to obtain information, not for you to prove innocence, they either have enough information to move forward or they don't.
I generally advise two camps on these, if your 100% innocent, cooperate 100%.
If you are guilty, shut up, use your right to silence and stay shut up until charged, or at least until you get a legal aid solicitor, which is after you are charged.Hi, we’ve had to remove your signature. Thanks I'll bare that in mind. Hopefully the former will be me and all I need to do is show them the paperwork that proves it is my mums account and nothing to do with me. I am planning to be 100% co-operative but I will be very cautious and bear your points in mind throughout the whole interview.0

You cant get into trouble for telling the truth.
You may have made a completely innocent mistake, like I say, they are trained to spot this and can tell.
Good luck and let us know how you get on.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
One thing I find strange is that both my husband and I claim community tax benefit and the bill comes in in both our names. Why is it only me getting pulled in and not my husband also? The mortgage is also in both our names although that is DWP and they have said that they are not involved and will not be attending the interview. Maybe that does make the part about my mums account more plausible as it is only me who is a signatory.0

Most likely from what you've said is that it's being a signatory on your Mum's bank a/c, show the people doing the interview all the evidence you have to prove that the money is your Mum's and not yours. I think that benefits are probably trying to say that being a signatory is the same as it being a joint a/c even though it's not.
I would suggest you take evidence relating to the car as well in case it's that. IMO if you're using the mobility part of the high rate mobility to repay the loan, it should be acceptable. Instead of it going on a motability car you're using it to pay for a car which meets the needs of both people who receive DLA.
Please come back when you know the outcome to let us all know. Hope it goes ok and that the interview results in case closed.0
