No, it's your opportunity to provide an explanation or rebuttal of what they think is evidence.
e.g if it's the loan you had that has appeared in your account then gone out again, they won't know what it's been used for or if you still have the cash.
You would be able to explain what was done with it.
Incidentally the police do not conduct benefit interviews (despite what someone has claimed) but they are sometimes asked to make an arrest so that the benefit investigators can carry out an interview.
Also, the reason that they will not discuss it over the phone is because they cannot. It could lead to them taking evidence from you without having issued the caution, which would make it inadmissible.
Go to the IUC, be honest, case should be closed. :cool:0 -
My son and husband are both on high rate and middle rate mobility and this money pays for the loan on our family car. I'd rather own a car than pay an extra £100 extra on top of the money I pay for the bank loan for the car for something I need to hand back and possibly pay for numerous scratches. That's just my opinion on a mobility car.
I'll make sure I think before jumping in and will ensure they tell me exactly what the meeting is about before I open my mouth. I'll probs take my aunt in with me as it sounds like a lawyer would cost me a fortune and I wouldn't get legal aid although I will go and get some advice from them.0 -

I know it's easy for me to say, but try not to worry yourself sick. Just go along on the day and tell the truth.
Usually when called for IUC, they do have some kind of evidence, but that doesn't mean you have knowingly done anything wrong. It could well be something you haven't even thought about or had forgotten about.
If you can take somebody in an official capacity with you on the day then DWP will tell them before the interview begins what the issue is.
Contrary to popular belief, DWP isn't overrun with ogres as staff. Interviewing staff are usually very understanding and very also experienced at dealing with out and out fraudsters and they will know how to recognise a genuine case.
If you need a break during the interview, just ask for one or have your appointed person request one if they think you will benefit from one.
You might have to wait a few weeks after the end of the interview to know what the outcome was, as the decisions are made by senior staff. This wait for the outcome letter can be the worse part.The bigger the bargain, the better I feel.

My mum only gets OAP disability. Why would they state that I have undeclared Capital if they are investigating my mum. She owns her house and doesn't get any other benefits. She refused to accept disability for her mental health issues for 15 years and has only recently accepted it. She believed she wasn't entitled even though her social worker and cpn's told her different so I doubt they're investigating her.0 -
Again easy to say but try not to worry, you say you havent done anything wrong, so if you are mistaken, dont worry about that either, these people are trained to spot a liar and they will know you are genuine if you have over looked something.

I should think this has something to do with you being a signatory on your mothers account. Go to her bank and explain the situation to them and get them to write a letter confirming you only have access to this account to pay your mothers bills. That her assets are not yours.
You have done nothing wrong. You dont have capital over the limits. What has most likely raised suspicion can easily be explained. Even if you dont take a lawyer with you, which I dont think is necessary in your case, you can take along someone with you for moral support. They will not be able to speak for you but it may help. If they followed up their enquiries with the bank then they'd see straight away that this is my mums account only. Wouldn't they do that before asking me in for an interview? Surely they'd speak or write to the bank and get confirmation first?

If you are in receipt of IS this should be a joint investigation with the DWP/JCP FIS as you should be on a passported benefit so unless they decide to cancel periods of your IS your council tax will not be affected.
Looking at the thread and what the OP has stated I would say it is probably to do with the bank loan and has come about as part of a data match.
If you took the loan out and used the money to purchase a car as stated, then take in your finance agreement and invoice for the car and all should go ok as this will prove your version of events.
But like I say as council tax is passported based on your IS so I would be surprised if the DWP were not going to be in attendance.
Although IS and ESA in payment together as separate claims is a little odd as either one of you should claim for the other on a joint claim, but I could be wrong!0 -
