    I am of the view that the email in itself is harassment in respect of the tenancy [rather than common harassment] and a breach of the right to quiet enjoyment

  • I have responded. If they don't reply what do I do. Do you think the police would come if I called them and said there will be a breach of the peace?

    Maybe worth speaking to them today, to warn that people have threatened to break into your house and you might need them to attend?

    Sounds like your landlord has a really bad grasp of the law. This would be my reply:

    "The landlord or agent has the legal right to enter the property at reasonable times of day to carry out the repairs for which the landlord is responsible and to inspect the condition and state of the repair of the property. The Landlord must give 24 hours’ notice in writing of an inspection or visit.
    The tenant has the legal right to live in the property as his or her home. The Landlord must ask the tenant’s permission before entering the premises.

    Statutory responsibilities and rights will apply to the landlord or agent and the tenant even if they are not included in the tenancy agreement.



    Tenant’s are required to have 24hr notice before the landlord or agent can enter the premises. Moreover, the tenant must grant permission. The tenant’s right to live in quiet enjoyment is a statutory right.


    Any attempt to break my statutory right to quiet enjoyment of my property will be reported to the police.



    Only under a situation that can be deemed as an “emergency” may the Landlord enter without permission. This will include situations like flooding or fire."

    Hi marliepanda, I don't have the vastly detailed knowledge that some others on here do. But I think I would feel the same way you do right now, being on my own too. In one of my previous rented houses, the LL took to just turning up on the doorstep with viewings, and whilst it never got to this stage, I can totally understand how intimidating it must be.

    Any way, back to the point...I would probably phone the police (non-emergency of course) and explain the situation, tell them they have given written confirmation of their intentions. They may send someone tomorrow, as you say. I don't know if this is the right or wrong thing to do, but it's what I'd probably do; maybe you could phone Shelter or CAB this afternoon and see what they think?

  • The bloke is a bully and I suspect that talk of locksmiths and Des removing the door are just empty threats.

    Your email sets out your position nicely. If you're gonna be at home for the viewing I'd just sit there in silence, don't answer the door and dial 999 if they start having a go at it. I really doubt they will though. I can't think of anything more likely to put off a prospective purchaser.

    You could maybe video or sound record what happens.

    I'm on the phone to Shelter at the mo (hold) and will call non emergency police after that.

    I emailed them the response above but have recieved no reply. I don't want it to even get to that point cos what if they DO take the door off? What do I do? Live without a door?

    All they care about it selling the property, they don't give a !!!! about me. I had hoped her forwarding it to the director would mean he had a clue but he's just 10x worse!

    They are not gonna take the door off. Why would they?

    If for some reason they try then call the police.

    If it comes to it and you can't get this sorted out today, do you have any one who would be available to come and sit with you? Not only would it maybe make you feel a bit safer, but also might make them less likely to intimidate you on the doorstep if you're not alone?

    I would be very surprised if they follow through on these threats, and you were copied in on that email to try and intimidate you. They're probably trying to think of a response now after you've made your position clear, which is why you're still waiting for a reply!

    Shelter was just one long string of recorded messages and I coudlnt seem to get through to a person.

    Rang the police, got through to control room, she said she is going to make some enquiries but she wasnt sure what they could do as its 'between me and the LA'

    I just don't want it to be true and them be bashing my door down at 2pm (I am working nights at the mo and will be in bed, hence me asking to rearrange)

    Just just truly awful people. On the phone it seemed to me that because Ive given notice that means I cant rearrange anything anymore. They are prob desperate to sell cos she prob cant afford her mortgage without my rent.
