UKPC parking charges at Boucher Crescent

Hi, I wonder if anyone can help, I was at Boucher retail park on Sunday and got a parking charge of £60 (paid within 14 days) rising to £90 if not. I hold my hands up and admit I was parked incorrectly - but it's the norm for there (no excuse I know - and yes I have learnt my lesson). But I'm wondering how enforceable this is, I had a look through the rest of the site and people say to ignore it, but has anybody in NI ever come across this company before and either ignored them or been hauled to court?
Thanks appreciate any help £60 is a fortune I don't have!

I got one of these letters 2 years ago for parking in the Co-Op on the Lisburn Road for over an hour. I ignored the first one and got about 8 more and more threatening letters over about 6 months, but there's no need to take them seriously.

They started with 'your fine has gone up to £90...', 'your fine is now £180...', 'your fine is now £360...failure to pay may result in court... blah blah...' etc.

Then the last few became 'your debt has been transferred to a collection company blah blah... you now owe us blah...' then they stopped sending them.

Once you know that they are empty threats you can laugh them off and show the letters to your friends and family so they know not to fall for it.

Its is completely unenforceable - however maybe since you were actually perked incorrectly you could consider doing the right thing and paying it?

Martin actually discussed this on Daybreak, or some of those programmes, and he said you can ignore it, because you can't be taken to court. Was it just like an invoice, and made up to look official. Unless it is given out by the redcoats, they are not enforceable.

I assume it's a free carpark? Even if you were over their allocated time they have to prove you were depriving them of something. Free =£0.00p. You would still owe them nothing.
  • Hi, I got one of these parking fines yesterday at Boucher Retail Park. It was for £90 but reduced to £55.50 if paid within 14 days. My vehicle was 'not parked correctly within the markings of the bay or space'. This is a free car park and I was not obstructing any other users or using a disabled parking space. In fact I should have been able to use a mother and toddler space but there were none available. Are these tickets enforceable or should I just pay up?

Just ignore it. It isn't a fine but an invitation to pay. They can't take you to court. They can't enforce it. In future maybe remember that taking up two space can inconvenience others shoppers.

Parking charges should be clearly detailed at all entrances to the car park, including charges for not parking in a marked bay correctly or staying beyond the allowed period. If these details were clearly displayed you can be charged if you fail to observe the parking rules. However the parking charges should be fair and be measurable in terms of the losses incurred by the owner of the car park because of your parking error.

The company will probably be able to obtain your name and address from your registration details but to enforce payment they would have to take you to court as it is a civil matter.

Have a read at this article - a similar scenario

I didn't - and would never - take up two parking spaces. I just 'tagged' on to the end of the row of parked cars - making the line longer - as the person in the row behind me had also done (they got a ticket too).
