    aw Fuddle just read your news hun I'm so sorry to hear that but as others have said it may work out for the best seeing as he's a prat..!!
    We were repossessed when DS2 was 8 weeks old and were around £40k in debt,we had no option but to throw ourselves on the mercy of our local council and while it was a very stressful time (they checked you out to see if you had intentionally made yourself homeless etc) we were quite happy to be put into temporary accom as it was better than our flat we had owned!

    We got rehoused after approx 6 months and thats a whole other story BUT it led to us being where we are now..

    I'm a great believer in fate and think if we hadn't have been through what we had I wouldn't
    1/be able or so keen to help others now
    2/be a stronger person for it all
    3/have such a lovely home for which I'll always be grateful for

    So what I'm trying to say *in my usual long winded roundabout way* is hang in there Sh*t happens for a reason and maybe this is your chance to get a more permanent solution I hope so as it will make an immense difference to your life to have somewhere settled XXXXX

    One other reminder Fuddle - even a S21 isnt an eviction notice, its a request by the LL asking you to leave, you can ignore it (some councils will expect you to ignore it in order to access their priority housing) and the LL then has t o apply to the courts to have formal eviction notices issued. If you ignore them he can apply for a repossession warrant. That all takes time, (we overstayed at our last place as we were held up buying this one - it overran by about six weeks in the end, but I knew it takes a while) so you do have time. And it sounds as though your LL has not got a clue.

    You need to check if your deposit is protected too if its not you can issue a claim against him but you need to go to the renting board for info on how to do that, I have never had that problem. :)
  • FUDDLE - I can't say anything to make it better but I'm so very sorry you have had this happen on top of everything else. I very much hope it turns out to be one of those situations that when you look back in the fullness of time you can make sense of why it happened because you are in a much better place. All I can do is send you all the strength and caring I have in me and my very very best wishes that this is sorted out to your advantage in the long term.     Sorry to hear this. Ok your rent due date is NOT NECESSARILY the same as a rent period. Go check your contract the date the rent started is the beginning of the rent period. E.g. Rent period 16th to 15th of each month but rent payable on 1st of month.
    So first go check your Agreement and check the deposit scheme info. If there is any problem you simply lodge a dispute with them the deposit scheme pronto.
    Second just have a look around and see what else may be better place to live, get an idea of costs and so on.
    Now go take pictures or video with commentary of dates and issues of all problem areas, clothes with issues and so on.
    Now document with dates all the issues you have had when was anything done and what is outstanding, for how long. Take pictures
    now, have a look at landlords.org or Shelter web site for the Section 21 info. It has to be in writing and with certain specific data in it and run from rent period for 2 months.
    Now breathe and remember as DD&D said this is an opportunity, you Amy ended up somewhere better, no damp and who knows cheaper.

    Again, thank you for all the well wishes and kidcat and everyone for your invaluable information. Our deposit is in with the DPS, I have the paperwork. In order to move we will need that deposit. I suspect I'm going to have to fight for it so this is the problem.

    DH is going to apply to vanquis for a credit card. Vanquis are well none in the ex-bankrupt world for supplying credit cards to us but with very high APR's. If he were to get accepted we could have access to money for the deposit we need in order to move and then pay it off with our deposit when we get it. Will will get it by the way, I'm determined because I've done nothing wrong and so much evidence against him the DPS will have no choice but to rule in our favour.

    I know going the credit card is not a good idea but right now it seems the only way to go... and I'm no longer stupid, neither is DH. Here's hoping anyway.

    That's plan 1. Plan 2 will be a very quick and radical food budget cut and sell stuff on ebay. We're not stuck. We're bliddy not!
  • Sorry to hear about your troubles Fuddle. As well as Shelter maybe contact your local council's homeless service. Here in Scotland part of their remit is to assist people in your position. Try not to worry

    Hold fire on the credit application Fuddle until you see what you need - some agents will not accept a credit card as deposit. Your councils homeless dept can help with advice on deposits etc and can usually supply a list of LL that they work with.

    So sorry Fuddle. As said you want to get away from private LL'ds and probably not my town but there are quite a few 2 bedroom properties up for rent/letting and the one over the road from me is in a nice quiet area and close to everything...just as an example...what a rotten time to be told to get out near Christmas...

    Fuddle have you thought about running your food stores down before you move as this'll help not only when you come to move but saving a few pennies now too..I saved supermarket stamps so we could do a big shop once we were moved in

    just to give you a laugh..I did this the first time we moved but had also stocked up on nappies,:o they were on a silly special at Kwiksave a triple pack for the price of one and at the time boys or girls.

    we knew we were having a boy so I bought 6 triple packs of every size :rotfl: I've never lived it down to this day the fact that one whole van was filled with just nappies!
