Even if you did get whiplash and a sore side, what has it actually cost you? you make no mention of being unable to work and losing pay or any other financial loss caused by this "accident" So why do you think you are entilted to compensation???.......if you think that suing the disabled father of your children for driving into a puddle which caused you no financial loss is the right thing to do.
When you suffer pain and injury you are entitled to compensation for the suffering irrespective of whether you have suffered any consequential financial loss for which you can also be compensated.
It is always the case that injured passengers need to make a claim off the driver (and who else can they claim off in this instance?)0 -
A car hitting 3ft deep water will stop pretty suddenly, but unless the driver wasn't paying attention I'd have thought they'd have been able to slow down to the point where they weren't going *that* fast. But whiplash *might* be possible. Were all the other occupants unharmed?
As an aside, I think even the mention of the car accident and a sore neck will result in diagnosis; there is no objective test whatsoever (as it's muscle pain), and they don't want to risk being sued for being negligent.
I do know they are trying to find a consistent and objective diagnosis to try and do something about the number of people suffering whiplash in low speed (i.e. no damage) collisions.
However, I have to ask; if you were in the car with your ex partner and children, and have a minor injury due to a no-fault accident, what do you gain from claiming? Anything you get in compensation (plus all of the overhead of litigation) will have to be paid for by increased insurance premiums.0 -

A Picasso has it's air intake underneath the engine. Driving that fast into even a small amount of water will take water into the engine, and that means a dead engine and a lot of money to fix.

I think the point that the OP may be missing here is who do you think you are claiming from? There isn't a magic compensation fund. You will be claiming against the drivers insurance which means their premiums go up.
It's their car that's knackered not yours. How bad is this 'whiplash'? Are you losing money from lost earnings? If not, what exactly is the compensation for? Is it because it was a scary experience?House saving Targets:

I don't quite understand myself how someone can get 'whiplash' from a car stalling and stopping. Are peoples necks that weak that they can't cope with a car slowing down? I don't personally see how it would be any different to completing an emergency stop which people do in their driving tests and they always come out fine?
