road traffic accident as a passenger

Hi everyone, I' new here and not sure if I am posting in the right place,
On saturday I was a passenger in a car and the driver stupidly drove through a flooded ford, (he was going a little to fast to stop!! anyway the car stopped dead and stalled in the middle!!!, as The water was still rising (almost to the bottom of the window) and was leaking into the car through the bottom of the doors I thought it best to get myself and my children out, so climbed though the window ( as the door wouldn't open) and carried my 2 y old and 5yr old to saftey.... the teenagers with us were able to get out and to saftey on their own, (it was a 7 seater picasso)
The driver stayed in the car until police and fire brigade arrived not long after as he is disabled and had banged his side as we came to a sudden halt and didnt think he could walk in the running ford.
The children were all fine, but i am now suffering with whiplash and very achy arms, back shoulders and side where the seat belt must have banged me..... Im just wondering if we would be able to claim compensation for injuries as it is a motobility car, thankyou for ay help

Each of you need to speak to a personal injury solicitor (you can find plenty who will pay you a commission just for instructing them on top of any compensation they get you - google cashback personal injury solicitors)

If they think you have a case, then they will proceed against the driver (his insurer will have to pay any damages you get) on a no win no fee basis.

It being a disabled driver in a motobility car makes no difference.

I don't quite understand myself how someone can get 'whiplash' from a car stalling and stopping. Are peoples necks that weak that they can't cope with a car slowing down? I don't personally see how it would be any different to completing an emergency stop which people do in their driving tests and they always come out fine?

If you really are injured however then contact a solicitor
  • he was driving at around 30/40mph on a back road and the ford was around the corner, we hit it at that speed so of course it would stop abruptly!!

But how is that any different to me doing 70mph, slamming my brakes on because someone stops in front of me. I don't walk away with soft tissue injuries? =/

If your injured though then as said, contact your GP, speak to a solicitor and leave it in their hands. That will be the only advice people can offer on here I'm afraid.
  • after a examination from the hospital they agree i have whiplash, and have treated me for that, with medication and neck brace, so thanks for your reply, i shall contact a solicitor

I hope you have your own car since I can't imagine anybody will offer you a lift ever again.
