    Hm, I wonder what actually is the legal position, when someone has been recorded without their knowledge or consent. In court it almost certainly would not be allowed as evidence, because of the possibility of the recording having been edited or tampered with, but a workplace disciplinary panel is obviously not a courtroom..

    so what if you've said a nasty comment its all skin off the ducks back. as someone else has pointed out point out that it has been tampered with. that its not reliable evidence. etc etc

    That would actually be pretty horrific.

    But it wasn't a "joke to ur m8s". According to even the OP's version it was a series of racist jokes told in the employers premises to some work colleagues. Education premises. There may or may not be mitigating circumstances, but that isn't relevant. If someone wants to tell jokes, and humour does not need to the racist, to their mates, then down the pub is an appropriate place to tell them. I seem to recall you are in care work. Would racist, or ageist,or jokes about states of mental health be acceptable fair for telling colleagues at work? In other words, jokes at the expense of your client group? Because there is clear and unequivocable guidance from your Inspectors to say it very definitely isn't. What makes it ok for someone in education to think racist jokes are appropriate material for the workplace? If the OP is telling the truth then I feel sorry for them, but that doesn't make it right, and a professional should know better.

    well I tend to keep my jokes out of the workplace but maybe he didn't think.

    depends what u call racism, i don't make bad jokes about other cultures but i beleive their the reason for so many of us being on the dole

  • Yes they should know better,but sometimes people make bad judgements due to lots of different reasons
    In my opinion the O.P needs to be thinking more about the strategies needed to get further work as they will not be able to say that they were sacked for racism!.
    I think they will be sacked because everywhere I have worked 1 racist joke would mean you were out of the door.
