    As far as I know the PIP criteria has not been finalised yet, these are just from draft proposals.

    We got our second motability car last month and had to sign a form motability are just bringing in saying the car will only be used for the disabled person, pretty much the same as the dvla website says re tax. I honestly dont think it really matters though. I am learning to drive at the moment (my husband is disabled not me) and the car is a family car so will be driven by me with or without my husband in it. You can argue that anything I do in it is for the benefit of my husband in one way or another. The regulations are just there to stop people living in. for example liverpool, taking out a motability agreement for a relative living in southampton, clearly that car is not being used for the benefit of the disabled person on a regular basis, its just an unscrupulous way of getting a cheap car. Sadly these things have been happening and are now being cracked down on.

    And yes these cars are not free at all, we had to make a payment on the car when we took out the agreement, and spend over £200 per month on the rental. Far from free. Yes it could be argued it is tax payers money, but it is money we would be given to help with his disability either way, if we choose to use it on a car rather than taxis then that is our decision.

    Im sure I read a reply mentioning jealousy early in this thread but how can you be jealous of something of you have been entitled to from the very begining of DLA mobility in 1992 (and how many of you can say the same btw)?

    No I am not. He receives his tax renewal, takes it to the post office with his insurance etc and receives a free tax disc. I am not stupid, I am not being lied to. The vehicle is registered as a disabled vehicle and he receives a free tax disc.
    What they are doing is illegal, they need to contact the DVLA to get the vehicle reclassed. If they get caught they will be prosecuted because their current tax disc will be void.

    Have they actually informed the DVLA that they now own the van or does the DVLA still think it's owned by the charity?

    I think this is why he thinks it's ok. The vehicle was owned by the charity, and I think they still think it's charity owned but he is the named driver. The first time he taxed it, he fully expected to pay, and was overjoyed when they handed over a free disc. I told him at the time that he should advise them it must be wrongly registered. I had then not given it much thought, as I don't see him regularly. I recently saw him and asked him and he was well pleased that he still gets the free disc. Unlike others have suggested above, he himself does not have any disability proof or benefits to show. He was recently stopped by the police, who unbelievably did not notice that his rear passengers were sitting on a SOFA!! Let alone his tax disc.
