Parking Eye help needed!
Comments
-
We had a parking eye letter through the post last week (parked in Fistral Beach Newquay) it's in hubby's name. I said ignore it so we did.
Had another letter today and I said ignore it again... hubby is worried about it though so I just thought I'd write on here so he knows it's ok to ignore.
Can someone put his mind at ease?
A message to your husband (similar to what I said to my concerned husband when I got a fake PCN 3 or 4 years ago):
A 'Parking Charge Notice' is NOT a real PCN but a fake one.
Just ignore it.
The most that will happen is even more junk mail letters that you can ignore; you are just in the middle of a mail scam at the moment.
No private parking company (PPC) can actually issue a real fine or penalty. Nor can they affect your credit rating nor send a bailiff round without the small matter of winning a Small Claim in Court first! Won't happen.
Please read on...
We have so much info on here to help newbies understand and be ready for the letters. One click & you see all current threads here, most of which are about the 'fake PCN' scam.
Third from the top, click on 'PPC letters & threats'.
1. Watch the Watchdog clip on there, and then
2. scroll down to the pics of your fave PPC's threatograms, then
3. Play a nice game of snap with each matching templated threatogram, then
4. Tell your friends & family, colleagues, strangers, everyone! about the fake PCN scam so they never pay one.
Your husband will know what we mean about this being a SCAM, and he will get confidence when he has seen the letters & watched the Watchdog clip. It worked with my OH and he knows I was right...as usual!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello, I've just been looking through the links/watchdog etc and my partner, like the lady above, thinks I should pay as I'm in the wrong. He is worried that I will get taken to court. Just reading through it all, do you usually get 5-6 letters and then they give up - I noticed one person mentioned that you might get called?
Would appreciate any advice on what happens in the end so i'm prepared for the on-sought of letters and standing strong.

The number of letters can vary, depending on the PPC and on how hard times are for them.
Not sure where your hubby is coming from here. Under Civil Law, the only redress available to a party for breach of contract is liquidated damages (actual financial losses incurred). You need to be a party to the contract (so it has to be the driver they pursue, not necessarily the Registered Keeper) and the parking company has to have sufficient rights over the land (effectively the owners) in order to form a contract with the driver anyway.
So on three counts they are absolutely stuffed from a legal perspective. They know this too, which is why the vast majority of PPCs don't do court ever, and of the few that do, they do it very very rarely and usually lose. I think its something like 0.0006% or something similar.
Their only method of making money is to try and scare people with threats of court, CCJs, bad credit records, bailiffs, etc., all of which - legally speaking - is utter tosh.
You'd be mad to pay up.Je Suis Cecil.0 -
The numbers of letters increase if you are silly enough to make contact with them.
Free car-park?
Parking outside trading hours?
Even a chimp could work out that the damages are zero.0 -
Well got my second letter today, telling me the reason why I got my ticket this time - durr - they have far too much money and time!
Anyway tomorrow is d-day for paying the lower amount - going to be strong, and follow everyone's advice - BE strong!0 -
Just think of what you'll spend the money on instead. That always helps!Je Suis Cecil.0

Well got my 3rd final notice now - I take it I should still ignore? - just been reading some other threads where people offer to pay the amount that the parking was? - Was I in the wrong? I'm thinking I was in the car, I could have broken down etc etc? Cheers all0

Snap! I do hope you didn't pay the 'fine'.
That little car park must be a real money spinner for these crooks.0 -
You didn't mention that there were actual parking fees due. Not that it makes a whole heap of difference. If you were to be scrupulously honest then you might have considered offering them the correct parking fees. However there's an argument that because they are chasing you for a completely disproportionate charge instead that they have waived their right to any parking fees due.
Its up to you.
By the way, I'll be stunned if that really is a 'final' demand. You haven't received the 'final final demand' or the 'no, really, honestly, this is definitely our final demand' letters yet!
I would carry on ignoring them, personally.Je Suis Cecil.0
