    An appeal will actually mean you get more mail

    They will see a hooked fish and write to you more!

    The is no appeal with private parking companies. So the thoughts of me and all on here is you will see pigs fly first.

    its ilegal for them to clamp for an unpaid aleged debt, alhough you dont need to worry about this as it wont ever happen.

    appealing is a waste of time, the junk mail threasty will soon start coming, and these should be ignored. if you want to stop them then jjust write back telling them to stop, otherwise you may take legal action against both the shop and the parking company for harrasment.

    Harassment is a criminal wrong, not civil - so any action will be expensive to pursue and risky if the judge does not agree. They can easily argue they have a valid debt, and are simply reqesting that the debt be paid - all this is allowable.

    Saying you'll take them to court will show you up as a bluff and bluster merchant, but if you ignore them they'll quickly move on to someone else they can indimidate.

    Ignoring them and having no contact will remain the best advice.

    Thanks for your replies, i guess i've nothing to worry about. Can't see how a Chorley based company would monitor clamping in South London anyhow? Let the cold shouldering commence! And notts phil, d'you mean those 'great s*x' emails are fake too? Now that is cause for concern! 8)))
  • We had one from Parking Eye this morning because we parked at Mostyn Champneys car park last week when we went to the theatre. We thought we'd be ok as it was night time and the shops were closed, so its not like we were preventing any shoppers from parking. I was going to email them and ask very nicely if they would consider waiving the fee but after doing a bit of research I'm happy that they haven't got a legal leg to stand on, so they can kiss my ***.

    This is not correct. Section 3 of the Protection from Harassment Act 1997: http://www.legislation.gov.uk/ukpga/1997/40
    expressly provides:
    (1)An actual or apprehended breach of section 1 may be the subject of a claim in civil proceedings by the person who is or may be the victim of the course of conduct in question.
    (2)On such a claim, damages may be awarded for (among other things) any anxiety caused by the harassment and any financial loss resulting from the harassment.

    We had a parking eye letter through the post last week (parked in Fistral Beach Newquay) it's in hubby's name. I said ignore it so we did.

    Had another letter today and I said ignore it again... hubby is worried about it though so I just thought I'd write on here so he knows it's ok to ignore.

    Can someone put his mind at ease?

    They are entitled to the actual financial losses they incurred. From the driver. And only if they are the landowner, not an agent of the landowner.

    I'm guessing this is zero.

    Ignore them.
