Who you you report smoking in vehicles to ?

My dad is having problems at work

He is a lorry driver and has his lorry for 4 days a week, the other 3 days another driver has it

The other driver is smoking in the vehicle and when my dad has it back it reeks of smoke, the steering wheel stinks too.

He has reported it to the boss who have said they have spoke to the other driver but it is still happening, he has even told other drivers he will not stop

My dad resorted to putting vic under his nose the other day !

My dad now want to take this further but i have looked on the interweb and cant find what he needs to do

any help would be appreciated

    He has tried Febreeze it does not work

    My dad lives in the lorry for 4 days and sleeps in it, smoking is illegal in a work vehicle, he should not have to put up with it IMO but we dont know who to report it to

    OP, I'm not sure that the smoking legislation covers your father's case as it is designed to protect people from inhaling second hand smoke, rather than just smelling the after effects.

    Its actually a criminal offence so the Police can deal with it, also the employer can be fined for not enforcing it.

    your dad could be fined if caught if there is even evidence that someone has been smoking in the vehicle, or it could be awkward until he could prove it wasn't him.


    Tendring District Council and Essex Police are stopping company vehicles across Essex during March in an effort to catch employees illegally having a smoke.

    Anyone caught smoking in a company car or van faces a £50 fixed penalty fine or being taken to court and issued with a £200 fine and a conviction.

    Council wardens and uniformed police officers are checking inside the vehicles for used ashtrays and the smell of smoke, and if they find evidence of smoking they will also alert the drivers’ bosses and employers who could also be fined.

    Smoking in work vehicles was made illegal under the Health Act in 2006 which banned smoking in all vehicles used primarily for business purposes by more than one person.

    Employers could face a fixed penalty notice of £200 or a maximum fine of £1,000 if convicted by a court if they have failed to display no-smoking signs in their staff vehicles.
    European for 3 weeks in August, the rest of the year only British and proud.

    Enforcement is by local councils - probably environmental health.

    It's not a health hazard. I don't like to agree with azari but I don't think the after effects of smoke are a health hazard. He should speak to his boss again or his bosses boss. If he keeps on complaining they could possibly move him to another vehicle. Or failing that speak to the other driver again. The other driver can choose to ignore it but that will lead to disciplinary action
