ASDA's stupid returns policy

tried returning my faulty bluray player to ASDA the other day. i still had the original box so i popped it in there. but guess what? they refused to replace/refund because i no longer had the instruction booklet. well, i say booklet... it was more of a leaflet. long gone, and quite rightly so. i had the receipt and everything... but they really wanted their printed sheet of paper back. now correct me if i'm wrong, but this goes against the Sale Of Goods Act 1979, doesn't it? as far as i've always know packaging and included printed papers etc are not essential for a successful returns. do ASDA really think i'll just write off £75 and let them get away with it? going to take this further. they don't seem to realise i have a lot of time on my hands and thrive on stupid vendettas like this. anyone had any experience of something similar?

    packaging is not required and dependent on length of ownership will adjust the route for a SOGA claim.

    How long have you owned it? Have you tried a different store? Sounds like you got an over zealous assistant.

    google the instrutions and print them off

    The instructions are not necessary, even the box is not necessary if the item is faulty.

    Go in ask to see the supervisor.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    i am always of cheerful and non-threatening disposition and unlikely to intimidate... but the woman from CS did seem like she was having a bad day. i asked nicely for a copy of the returns policy, and then she called the floor manager. and the floor manager told me the same thing! i asked her to put her statement in writing and she flatly refused, then suddenly said that the electrical department manager was in fact the only one who could deal with my query... and he wasn't in that day! wow, what good fortune. left my number and waited for a call. still waiting. wrote a nice long letter to the store manager quoting SOGA etc. sent registered post and awaiting reply. just can't believe a big company like ASDA would try and pull a fast one like this.

    oh, and i've had the machine about 6 months. only really used recently though. (and i know it is faulty through no fault of my own.)

    Is "about six months" over or under six months?

    If you bought the thing over six months ago you could be asked to prove the fault is inherent.
    And "and i know it is faulty through no fault of my own" is not proof.

    Also, if you start talking about "asking to put her statement in writing" and "a nice long letter to the store manager quoting SOGA" I would be preparing myself for a bit of awkwardness on their part too.
  • Write a simple letter, these companies do annoy because they can.

    Firstly there is no such thing as a manager within ASDA.

    I am very suprised that you even had the receipt, my ASDA receipts fade away after 3 months.

    I dont buy from them anymore because of the headache I get returning cheap faulty items

    Personally never had a problem returning things to Asda. In my local store there is often a trolley full of unboxed returns at the CS desk so think it's just this store being difficult - as suggested, try another store?
