Excel Parking - HELP should I pay the ticket?

I wonder if anyone can offer any help or advise over a parking ticket I got from Excel Parking.
My boyfriend had gone to B&Q to buy things for the bathroom as he was putting in a new one for me.
Unfortunately something he bought wasn't right so I took it back - using is his car as he had blocked me in, as he needed it quickly being in the middle of doing the job.
When I came back out of the store I had received a parking ticket for being parked there for longer than allowed!!! I went into B&Q who advised to write with my recipts as evidence as they have it all the time and they are getting annoyed with it.
I today got a letter back stating that the ticket still stands as I had returned within 3 hours and apprenetly your not allowed to! The ticket does not state I was given it for this reason - although this is an option, therefore how can they enfore this when I can prove that the ticket isn't right? Surely they can't just change the reason on the ticket?

I have spoken to a manager at B&Q who admit that this is a silly rule, of course people may need longer than 1.5 hours and have to return within 3 hours - its DIY and these things happen!

I've read that read that I should ignore it, but its on a company car so can't they go to the company? I don't want any repocussion!

Any help would be appreciated as its really got my blood boiling - especially as B&Q say I shouldn't pay either!

    Is it B&Q's car park, did they contract the parking company?

    the usual advice is to ignore, but if that B&Q is gettign fed up keep ignoring, and then you can ask that B&Q to stop sendiong you these letters, as they are jointly liable for the actions of their agents, this will probably go no where, but you should collect the entire letter chain once its almost run its couse, ask B&Q again why they havent stopped, and tell them that as they are liable for the actions of their agents your in a good mind to take legal action against that B&Q store for harrasment.

    The company is called Excel Parking, but I will definately being going back to B&Q.
    Its just one large store (comet, argos, wren, staples etc) which are on an industrial estate - aparently lots of people get tickets who are going for kitchen or bathroom designs at these stores and who need more than the 1.5 hrs they let you have!!

    Ignore Excel. There tickets are unenforceable, they cant do a thing. A recent ruling in the Upper Tax Tribunal recently pulled the wings off there business model, and they have no legal ability to offer parking or pursue motorists for there ridiculous illegal charges.

    The ywill continue to harass you as long as you play there silly game, so the first rule is IGNORE, IGNORE ,IGNORE.

    The only way they have of getting you to pay is to scare you into paying, thus you will receive a long chain of threatening letters (know on here as 'threatograms'), all look very scary and convincing, and all are utterly toothless and unenforceable, and none of the bad things the threaten will happen if you dont pay up can in fact happen. there ticket has no legal merit or basis. The ywill eve nsend you letters from fake debt collectors and fake solictors. All can do nothing in practice except send scary words.

    So from now on, feel free to ignore them.

    On the other hand, if you dont feel like ignoring, and want some fun, some things you might like to do:

    - ring up B&Q and tell them if there agents Excel continue to harass you , you will report both Excel and B&Q to the police for harassment under the Protection from Harassment Act 1997.

    the consequence of this ruling is that Excel, l;like every other private parking company who doesnt own the land it patrols, now has absolutely no legal right to operate as it does, period.

    -conversely, you might want to drop a subtle hint to Excel by taking a large thick felt tip and writing "F*CK OFF" two inches high over the letter they sent and sending it back in an unstamped envelope, along with printouts of all the above.

    You MUST be proactive and - assertively but politely - TELL your company (and lease co if there is one) that they must not pay it as it's a scam.

    See the linked thread, which also gives a link to a couple of other similar and informative threads plus some useful links such as to the BVRLA if a lease co is involved. Read them all and formulate a letter to send to the Fleet Manager and a letter to send to Parking Eye, one more response only, to invite them to 'take me to Court then or shut up'. You really need to hook PE well and truly in your direction and away from any Fleet Manager who may just pay the thing and try to take it out of your salary (not lawful as almost certainly this unsolicited invoice is not covered by your car use t&cs).

    As you have already written to PE it may be they will send the usual letters to you - but the normal situation is that they buy the registered keeper/owner's details from the DVLA ...that's what you don't want but it could happen so you do need to be proactive like in the linked thread and the others linked within it.

    If you are not permitted to return, they are alleging trespass must occur when you come back.

    Damages for trespass are only claimable by the landowner.

    And rather than causing damage, you are in fact benefiting the landowner on your return. Otherwise, every customer would cause damage by shopping!

    Utterly absurd claim by Excel, and it doesn't take a genius to realise why there has never been a 'no return' case put through small claims.

    Ignore everything. It's a shame you're a newbie - it's a nice 'fightback' situation.

    just relax, excell are a joke and nothing but scammers, you havce NOT been fined, NOT recieved a ticket and NOT commited any offence, what you have recieved is nothing more than loo paper and when you have finished doing with it what you usually do ,simply press flush AND FORGET ABOUT THIS,,nothing can/will happen, but be prepared for some threat o grams from not only excell, but roxburghe and the phoney solicitor graham white again, these are all part of the scam,do not worry, chill , relax, feet upo, watch the footy and come back hewre anytime for reassurance,,finally a legit ticket is called a PENALTY charge notice,must be paid and issued by police/traffic warden ,,you DO NOT have this,, you have a fake ticket called a PARKING charge notice=not legit=fake=loo paper=toilet=flush,,so there you go, aint the job a real good un.

    IGNORE everything from those lowlifes there only a small part of the scum of the earth who will try there best to fear you into parting with your cash to fill up there FILTHY bank account to help fill up there directors wallets for a cushy life :money:
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    There is a reason for the 90 minute stay and no return in 3 hours, it's so they can scam as many legitimate customers of the retailers as possible. They leach off motorists and are really a despicable company, the same for all parking companies. You need to follow coupons advice above as it's a company vehicle.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Ignore the scammers, the landowner has suffered nil losses of you returning to park within the so-called "no returns" rule.

    I have a better idea:
    IGNORE Excel they are impersonation of authority scam artists and in future if you want any DIY products, use a store that does not have scammers operating in the car park like B+Q
