OP was a little bit careless it was an avoidable accident, luckily the person seems reasonable and is going for a cheaper option.

I even stated in the post title that it was a silly question - I was just really unsure. I'm pretty new to car insurance and as my previous experience of a 'deposit' meant you would get it back, I was just wondering.
