Amazon cancellation request help

    Can anyone confirm that the above (distance selling regulations) only applies to businesses and not private sellers?

    He thinks because he ordered through amazons website (from a private marketplace seller) that the DSR applies...

    Stop getting involved with your buyer, you have stated your case and will refund upon return the 7 days are not an issue if he refused delivery, it will come back (fairly quickly idf refused).

    If he is not happy with refund less P+P point him to the A-Z Guarantee and tell him to get on with it. If you really are concerened then refund the lot (but I don't do tha when customers !!!! up). You will however be covered under DSR but I still don't think that applies to your P+P.

    He wants to take me to the small claims court over a maximum of £4.50! It may even be as little as £2 if I decided to just refund everything but my actual postage costs incurred!

    Has anyone ever dealt with someone like this before?

    Amazon themselves refund original delivery costs but not return delivery costs under the DSR

    does that mean I would have to aswell?

    Don't let him toy with you. If you must reply, tell him again to return the item.

    Don't do a thing until you get it back. No need to worry yourself further until you do.
    My TV is broken! :cry:
    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    He can't return it now as he has refused delivery of it and has been told that it will be returned to me.

    He believes that refusing the delivery counts as returning it, but he wants the full amount he paid including delivery costs refunded when i get it back!

    From the buyer:

    "From the Amazon Website

    "To be eligible for a refund, you must return your item to your seller in the same condition you received it, and the return must be postmarked within one week of receipt. Postage charges for returning the item are borne by you. Find out more below on how your refund will be handled. "

    So it's when I returned (or refused) it that counts. That was certainly within seven days."

    I replied:

    "I am not disputing the fact that it was returned (or refused) within 7 days.

    I am not sure if refusing it does count since Amazon state that you were meant to return it yourself and pay postage.

    I have however still agreed to refund the item cost upon receipt of it back."
