. And finally got the name of the truck driver now, but again that fleet manager is stalling me by not giving out the contact details of the driver - what good is just a name when it comes to insurance.......

He is an employee, and his address is irrelevant. Use the company address.

Thinking about it, company name, company address, and the fleet manager sorts it out. If you know the driver that's a plus point, but the fleet manager is probably the contact on the insurance.

Mikey72 and Quentin are correct - you have absolutely no need to know who the individual driver is of the vehicle just that it is driven by an employer of theirs on their fleet insurance. Your claim is against 3663 not the individual driver.

My parked car was crashed into by a lorry driver of another company last year, and I just dealt with the fleet manager. Unlike in your case he was co-operative as there was a witness who saw him damage two vehicles.

  • As previously mentioned the claim is against the company and not the individual.

This is a simple non fault claim and with the bonus of cctv footage it is one that cannot be argued, therefore liability is not the issue and therefore there are no justifiable reasons for delay in commencing repairs and providing alternative means of transport.

The only delay here is down to the big company culture, if it is something that does not affect their movement of product they will not see this as a matter to focus on!

To seriously progress this you have got to hope that somebody somewhere in the PR department catches glimpse of negative publicity and makes a call to the big knobs @ 3663 and suggests it would be beneficial to bring this to a swift end!

Would be worth a little call to the PR agents for 3663 who are publicasity, apparently not allowed to post with links so you will need to add the dots!. www publicasity co uk

BTW one use of twitter, particularly if you have one or more influential followers, is to bring shame to companies like this who delay acting in clear cut cases.

Id follow the MD on linkedin that someone said earlier, tel him what happened and link him to the video and maybe do twitter route too.
  • Thanks for the feedback guys, I was trying to collect the drivers details as that is something my legal cover guys will require if 3663's insurers start playing games later on and also the police officer at holborn station suggested to pass on any further info if and when I find out once I receive response from the police for that 20 page section-4 form that i filled out earlier.
At this point just waiting up for their insurers to get back to me over this week and take it from there I suppose. Like many of you have suggested it should be a open-shut case given the evidence available and the nature of the accident.
  • Got a call from VMS this morning re hire vehicle etc - now they want to send out an engineer to assess the damages to the motorbike. If they were going to do this anyways why bother asking me to get a repair quote in the first place wasting my time and effort, they could have sent out the engineer immediately right...the insurers wrote to me on 1st june as per the date on the letter(although I received it only on 8th June), so they could have sent the engineers with days after that rather than delaying a further 15 days.....I wonder if they were trying to get away with it all by waiting and watching if I can produce any evidence that 3663's truck was responsible and if I did not have any then they might have tried to wash it off their hands I suppose !!

Didn't someone from VMS post advice in this thread?

In which case they may be aware of the theft complication (though it isn't unusual to have engineers sent out long after the incident to do an inspection (sometimes even after repairs have been completed).
