Well, they're taking it to Honda to get a report from them as to the failure, we'll see what Honda say.

They also took it to kwik-fit who said the gases were fine in the system. The compressor clutch was kicking in, but it could be the condenser. I have a text and email stating that too. however I've never heard of a condenser failing as it's essentially just a radiator, the only thing could have been damage on their journey back, and then the gases wouldn't be fine.

I'm guessing it's something simple like a fuse or a relay.

I've taken legal advice from my home insurance legal advice line who also says they don't have any legal comeback as the ad wasn't mis-described.

A little comfort for you, though, (what with having to put up with mikey72 advising the other side pro bono!)

Easy one then. The op has said the buyer has already lawyered up, when he goes to court with the engineers report stating it's still working perfectly, he'll be bound to lose. If however, he has a report stating the aircon had a leak, and must have topped up hours before, and that the car wasn't "in great condition, good value" he may have a better chance. http://www.which.co.uk/consumer-rights/sale-of-goods/your-rights-buying-second-hand-cars/used-car-problems-faqs/

They took it to kwik-fit who stated there was still plenty of gas in the system.

In this case, the description was essentially true - the car DOES have airconditioning fitted. Whether or not it's working doesn't alter that fact.
The advert said it had air-con and said that the car was in great condition.
I thnk any reasonable person would take that to mean the air-con was working.

OP, the only problem will be if you were aware the air-con was dodgy beforehand and bodged it to make it work while the sale happened. A bit like Matilda's dad used to do, I think, with sawdust in the engine.
You know if you've done this or not. If you have then you might be in trouble as if it gets to court and you lose you'll have to pay their legal fees. But if you haven't then you should be fine.

    Given that the OP has aready posted the following;

Thing is, I have a text from them saying it WAS working on the way home as they got too chilly and had to turn it off... So it definitely was working when they left.

I don't really understand what people are arguing about.

Given you seem to advocate ripping people off I'd say this is essentially karma.

    5t.

That's quite a serious accusation to make against another member. Can you back it up with evidence? Oh, of course you can't, but then you have previous form for making accusations which you are unable to substantiate.

...and also that it needed brake pads, coolant, an oil change, 5 new tyres, 8 new shock absorbers, new headlight fluid and a replacement flux capacitor relay, about £2000 worth of work.

So now they're annoyed at the unexpected cost and are trying to use the aircon fault as an excuse to avoid getting it done.

    Maybe.

Actually the tyres were almost brand new, it was serviced in september, when I had the brakes checked, and I've done about 2000 miles since, as for the flux capacitor, wish it did have one so I could have gone into the future to see what'd happen to it!

The condenser could have been damaged by a stone on their return journey after buying the car.

If the air-con worked at point of sale (as advertised) and the OP has a text confirming it was , I don't see how the buyer has any come-back.
